And now here at this Day (to witt) the 28th day of June Annoque Domini
1696 Came the Sheriffe and made Returne of of the Said writt Endorsed on the
back (Cepi per Thomas Greenfeild Sheriffe) And it is here in Court testified that
the Said John Walker Since the Serving of the aforesaid writt upon him is Run-
away and Elloined himselfe out of the Jurisdiction of this Court. Whereupon
the Said Joshua Cecell by his Attorney aforesaid prayeth Judgment against the
Estate of the Said John Forrest for his Debt for Damages aforesaid and his Costs
in this behalfe Laid out and Expended etc.
Therefore it is Considered that the Said Joshua Cecell Recover against the Said
John Walker as well the Sume of one thowsand thirty Eight lbs. of tobaccoe his
Debt for Damages aforesaid as alsoe the Sume of two hundred pounds of tobaccoe
his Costs and Charges in this behalfe Laid out and Expended etc. and by the
Court here Adjudged etc. of the goods and Chatties which were of the Said John
Forrest at the time of his Death in the hands of the Said John Walker to be
Administred And the Said John Walker in mercy etc.
[325] Edward and Dudley Carleton plantiffe: Thomas Tracey Defendant
The plantiffes by William Stone their Attorney brought their Majesties writt
against the Defendant in a plea of trespass upon the Case etc. Upon which the
plantiffes by their Attorney aforesaid prayeth Spetiall baile may be given to the
Action aforesaid with Stay of Execution untill the tenth day of October next and
it is granted unto them Whereupon Came Robert Brothers into Court and offered
himselfe to be Spetiall baile for the Said Thomas Tracey in the plea Aforesaid
According to forme of Law etc. But by Reason there is not any Decleration or
Account filed to Shew for what the plantiffes Sued the Defendant for Noe Judg-
ment Could be Entred Although the Said Defendant Came into open Court by
John Meriton his Attorney and Confessed Judgment to the plantiffe for the Debt
for Damages Sued for when the Declaration is filed and Accounts proved Accord-
ing to Law etc.
Thomas Taney and uxor Administratrix of Henry Trueman plantiffe: Ignatias
Greycroft Defendant
Prince Georges County Ss. Ignatias Creycroft Late of Prince Georges County
gentleman was Attached to Answer unto Thomas Taney and Jane his wife Ad-
ministratrix of the goods and Chatties which were of Henry Trueman Deceased
of a plea of trespass upon the Case etc.
Whereupon the Said Thomas and Jane by John Meriton their Attorney Com-
plaineth that whereas the Said Henry Trueman in his Life time that is to Say
the first day of September in the yeare of our Lord 1695 at Calvert Towne that is
to Say at Charles Towne within the Jurisdiction of this Court was possesed of
thirteen head of hoggs of the price of three thowsand nine hundred pounds of
tobaccoe as of his owne propper hoggs and marked with the proper marke of the
Said Henry Trueman (Viz.) a Cropp two Slitts and under bitt on the Right
Eare and Cropp and two Slitts on the Left Eare and being there of Soe possesed
the Said Henry Lost those hoggs out of his hands and possesion which Said hoggs
afterwards the Second day of September Annoque Domini 1695 att Calvert
County that is to Say at Mattapony hundred within the Jurisdiction of this Court
in the Life time of him the Said Henry by finding Came to the hands and posse-
sion of the Said Ignatias Yet the Said Ignatias knowing those hoggs to be proper
hoggs of him the Said Henry and to him in his Life time to pertaine and to her
the Said Jane while She was Sole after the Death of the Said Henry to whome
