The plantiffe by William Stone his Attorney brought his Majesties writt against
the Defendant in a plea of Debt for four hundred Seaventy and Nine pounds of
good Sound Merchantable Leafe tobaccoe and Caske Due by bill as by the Said
bill with the Scale of Said John Forrest in his Life time Signed and here in Court
produced bearing date the twenty Sixth day of December Annoque Domini 1696
more at Large may Appeare etc. And now here at this day to witt the twenty
Eight day of June Annoque Domini 1698 Came the Sheriffe and made Returne of
the Said writt Endorsed on the back (Cepi per Thomas Greenfeild Sheriff) And
it is further testified here in Court that the Said John Walker is Runaway and
Elloined himselfe out of the Jurisdiction of this Court Whereupon the Said
Josias Towgood prayeth Judgement against the Estate of the Said John Forrest
for his Debt aforesaid and his Costs in this behalfe Laid out and Expended etc.

Therefore it is Considered that the Said Josias Towgood Recover against the
[Said] John Walker As well the Sume of four hundred Seaventy nine pounds of
tobaccoe his Debt aforesaid and his Damages by Occation of Deteyning of the
Said Debt two hundred and Sixteene pounds of tobaccoe to the Said Josias Tow-
good of his Assent by the Court here Adjudged of the goods and Chatties which
were of the Said John Forrest at the time of his Death in the hands of the Said
John Walker to be Administred And the Said John Walker in mercy etc.
