Regarding but minding and Fraudulently Intending him the Said William in
this behalfe Craftily and Subtilly to deceive and defraud the Said Sume of four
hundred pounds of tobaccoe or any part thereof to the Said William hath not
paid Although the Said Thomas to doe the Same by the Said William After-
wards the day and place aforesaid was often thereunto Requested but hath
hitherto Refused and Still doth Refuse to the Damage of the Said William of
800 pounds of tobaccoe and thereof he bringeth his Suite etc.

[304] The plantiffe haveing Issued forth a writt against the Defendant and
Likewise have Caused a Coppy of the Decleration to be by the Sheriffe Left
with the defendant at the time of Serving the Said writt which was Eight dayes
before this Court Whereupon the Said plantiffe prayeth that the Said Defendant
to his Decleration aforesaid this Court may Answer According to Act of Assem-
bly in Such Cases made and provided etc.
Whereupon the Said Thomas Padgett by William Stone his Attorney Cometh
and defendeth the force and Injury when etc. and Saith that he did not Assume
in manner and forme as the plantiffe in his Decleration aforesaid hath Com-
plained and of this he puts himselfe upon the Court. William Stone.

The truth of the matter in Controversie between the parties aforesaid by the
Court here being Seen heard understood and Maturely deliberated It is there-
upon Considered that the Said William Dent take nothing by his Said writt
but be in mercy for his false Clamor and that the Said Thomas Padgett goe
thereof without day etc. It is Likewise Considered that the Said Thomas Pagett
Recover against the Said William Dent his damages by Occation of the premises
to two hundred Sixty one pounds of tobaccoe to the Said Thomas Padgett by
the discretion of the Justices here at his Request for his Cost and Charges in
this behalfe Sustained According to the forme of the Statute etc. by the Court
here Adjudged etc.
Andrew Robinson plantiffe: Ambros Shipwash Defendant
The plantiffe by his Attorney Sues the defendant in a plea of trespass upon
the Case etc. being for two hundred and fifty pounds of tobaccoe due by Account
as by Decleration filed and Account here Entred may Appeare etc.

March the 23 1697[1698]: Then Came into Court Andrew Robinson and made
oath that the above Account is Just and true and that he never Received any
part thereof.
