MARCH, 1697/8 COURT 331

within the Jurisdiction of this Court Stood Indebted unto the Said Hugh in the
Sume of twelve hundred pounds of good Sound Marchantable Leafe tobaccoe in
Caske to Containe the Same As by a noate Subscribed with the proper hand
writeing of the Said William and here in Court produced Relation being there-
unto had may more at Large Appeare And the Said William to the Said Hugh
in manner aforesaid being indebted Inconsideration thereof did Assume upon
himselfe and to the Said Hugh then and there Faithfully promise [that he the]
[303] Said William the Said Sume of 1200 lbs. of tobaccoe Conditioned as afore-
said unto the Said Hugh when he Should be thereunto Requested would well
and truly Content and pay Nevertheless the Said William his promise and As-
sumpson Soe as aforesaid made not at all Regarding but minding and Fraudu-
lently Intending the Said Hugh in this behalfe Craftily and Subtilly to deceive
and defraud the Said Sume of 1200 lbs. of tobaccoe or any part thereof to the
Said Hugh hath not paid Although the Said William to pay the Same to the
Said Hugh Afterwards the 10th day of December 1697 att Charles Towne afore-
said was often thereunto Requested but the Same to pay to the Said Hugh hath
denyed and Still doth denye to the Damage of the Said Hugh of 2000 lbs. of
tobaccoe and thereof he brings this Suite etc.

Pledges etc. John Doe, Richard Roe. William Stone.

The Said plantiffe by his Attorney aforesaid haveing Issued out a writt against
the Defendant which Said writt was by the Sheriffe Returned that the Said
Defendant is not to be found in his balywick and alsoe have Caused a Coppy
of the Cause of Action to be Left at the house where the defendant Last Lived in
this County. And upon which it is on part of the Said Hugh Furguson testified
here in Court that the Said William Arther hath Eloyned himselfe out of the
Jurisdiction of this Court Whereupon the Said Hugh Furguson by William
Stone his Attorney prayeth an Attachment against the goods Chatties and
Creditts of the Said William Arther as well for the Said Sume of twelve hundred
pounds of tobaccoe his debt for Damages aforesaid as alsoe for the Sume of
four hundred Seaventy nine pounds of tobaccoe for his Costs and Charges in
this behalfe Laid out and Expended etc. And by the Court here it is granted
unto him etc.

William Dent plantiffe: Thomas Padgett Defendant

Prince Georges County Ss. Thomas Padgett Late of Prince Georges County
planter was Attached to Answer unto William Dent of a plea of trespass upon
the Case etc.

And Whereupon the Said William by John Meriton his Attorney Complaineth
that Whereas the Said Thomas the 16th day of March in the yeare of our Lord
1695 [1696] at Charles Towne within the Jurisdiction of this Court was In-
debted unto the Said William in the Sume of four hundred pounds of tobaccoe
being as well for his the Said Thomas noate to pay the Said William for Henry
Pagett as alsoe for two Attorneys Fees for the Said Thomas in Calvert County
at the Suite of Samuell Wattkins and Robert Hawkins as by a pertickeler Ac-
count thereof here in Court produced Relation being thereunto had may more
att Large Appeare And the Said Thomas to the Said William in manner afore-
said being indebted the Said Thomas Inconsideration thereof did Assume upon
himselfe and to the Said William then and there Faithfully promise that he the
Said Thomas the Said Sume of 400 lbs. of tobaccoe to the Said William when
he Should be thereunto Requested would well and truly Content and pay Never-
theless the Said Thomas his promise and Assumption Soe as aforesaid made not
