at the time of the Serving the Said writt which was Eight dayes before this
Court prayeth that the Said Ambros Shipwash to his Decleration may Answer
this Court According to an Act of Assembly in this or Such Cases made and
provided etc. And the Said Ambros Shipwash in his proper person Cometh
and Defendeth the force and Injury when etc. and Saith that he Cannot gainsay
the Action of the Said Andrew Robinson nor but the Said two hundred and
fifty pounds of tobaccoe is due and owing from him the Said Ambros Shipwash
unto the Said Andrew Robinson in manner and forme as the Said Andrew
Robinson against him hath Declared etc.
Therefore it is Considered that the Said Andrew Robinson Recover against
the Said Ambros Shipwash as well the Sume of two hundred and fifty pounds
of tobaccoe his debt for Damages Aforesaid as alsoe the Sume of two hundred
thirty Six pounds of tobaccoe to the Said Andrew Robinson of his Assent for
his Costs and Charges in this behalfe Laid out and Expended etc. by the Court
here Adjudged etc. And the Said Ambros Shipwash in mercy etc.
James Moore plantiffe: George Miller Defendant
The plantiffe by William Stone his Attorney brought his Majesties writt
against the defendant in a plea of trespass upon the Case etc. being for five
hundred twenty four pounds of tobaccoe due by Account as by Decleration filed
Account here Entred may Appeare etc.

[305] The plantiffe by William Stone his Attorney haveing Caused a Coppy
of the Decleration by the Sheriffe delivered to the Defendant att the the time
of the Serving the writt upon the Said defendant which was Eight dayes before
this Court Whereupon the Said plantiffe prayeth that the Said Defendant to his
Decleration this Court may Answer According to An Act of Assembly in Such
Cases made and provided etc.
Whereupon the Said George Miller in his proper person Cometh and De-
fendeth the force and Injury when etc. And Saith that he Cannot gainsay the
Action of the Said James Moore nor butt the Said five hundred twenty four
pounds of tobaccoe is due and owing to the Said James Moore in manner and
forme as the Said James Moore against him hath Declared etc.
Therefore It is Considered that the Said James Moore Recover against the Said
George Miller as well the Sume of five hundred twenty four pounds of tobaccoe
his Debt for Damages aforesaid as alsoe the Sume of two hundred ninty Six
pounds of tobaccoe to the Said James Moore of his Assent for his Costs and
Charges in this behalfe Laid out and Expended etc. by the Court here Adjudged
etc. And the Said George Miller in mercy etc.

The plantiffe by John Meriton his Attorney brought his Majesties writt
against the Defendant in a plea of Debt for the full and Just Sume of two
thowsand four hundred Sixty and Six pounds pounds of good Sound Merchant-
