JANUARY, 1697/8 COURTS 313

unto the Estate of Richard Charlett Eight hundred Eighty four lbs. of tobac-
coe. John Wightt, William Wilkinson.

And Imediately Came here into Court Hugh Williams and Elizabeth his wife
Administratrix of the goods and Chatties of William Graves deceased and
produced An Oath of one James Cobb as followeth not produced to the aforesaid
Auditors (Viz.) November the 17th 1697. Then Came James Cobb before us
and made oath that he paid to Richard Charlett about five yeare agoe Nine
hundred lbs. of tobaccoe upon the Account of William Graves proved before
Walter Smith and Francis Hutchings two of his Majesties Justices of the peace
for Calvert County as wittness our hands.

All which being by the Court here Seen heard and understood it doth appeare
the plantiffe to be Indebted to the Defendants Sixteen pounds of tobaccoe.
Therefore it is Considered that the Said plantiffe take nothing by his Said writt
but be in mercy etc. and that the Said Hugh and Elizabeth goe thereof without
day etc. the plantiffe not paying any Cost he being an Administrator etc.

[287] Thomas Greenfeild Administrator of Richard Charlett plantiffe: Phillip
Willesey Defendant

The plantiffe by William Stone his Attorney Sues the defendant in a plea
of trespass upon the Case etc. as by Decleration filed and Account here Entered
Appeareth etc.
