and unjustly Deteyneth etc. As by Decleration filed and bill filed beareing date
the Eighteen day of November Annoque Domini 1691 may appeare etc.

And the Said Robert Pearce by James Cranford his Attorney Cometh and de-
fendeth the force and Injury when etc. and prayeth Lycence thereof to imparle
here untill next Court and it is granted unto him the Same day is given unto
the plantiffe Likewise etc.

And now here at this day (to witt) the 25th day of January in the yeare of
our Lord 1697 [1698] Came as well the Said John Allten as the Said Robert
Pearcey by their Attorneys aforesaid and the Said John Allten prayeth that the
Said Robert Pearce to his Declaration may Answer etc.

And the Said Robert Pearce by his Attorney aforesaid Cometh and Defendeth
the force and Injury when etc. And Saith nothing in barr of the Action of the
Said John Allten by which the Said John Allten Remaineth against the Said
Robert Pearce thereof without Defence etc.

Therefore it is Considered that the Said John Allten Recover against the Said
Robert Pearce the Sume of Eight hundred pounds of tobaccoe his debt aforesaid
and his Damages by Occation of Deteyning the Said Debt two hundred forty
four pounds of tobaccoe to the Said John Allten of his Assent by the Court here
Adjudged etc. And the Said Robert Pearce in mercy etc.
