Cometh and defendeth the force and Injury when etc. And Saith that he did not
Assume in manner and forme as the plantiffe in his Decleration aforesaid etc.
hath Complained and of this he puts himselfe upon the Court. William Stone.
And the plantiffe Allsoe. John Meriton.
The truth of the matter in Controversie between the parties aforesaid being by
the Court here Seen heard and Maturely Deliberated It is thereupon Consiered
that the Said Joseph Hanslop Recover against the Said Samuell Harrwood as well
the Sume of two hundred thirty two pounds of tobaccoe his Damages in the
premises as allsoe the Sume of two hundred Seaventy Six pounds of tobaccoe to
the Said Joseph Hanslop at his Request for his Costs and Charges in this behalfe
Sustained and by the Court here Adjudged etc. And the Said Samuell Harrwood
in mercy etc.
Then did the Court Adjourne untill to morrow morning 8 a Clock.
Present. Mr. Thomas Hollyday, Mr. William Barton, Mr. John Wightt, Mr.
John Smith, Mr. John Hawkins, Commisoners.
Ordered that William Ray be Subpoenaed for Hugh Reyly against Major
Nicholas Sawell.
Richard Stevens Came into open Court and Acknowledged himselfe Indebted
unto Joshua Cecell in the Sume of Seven hundred twenty Seven pounds of
tobaccoe And prayed that Judgment might be Entred against him for the Same in
the Records of this Court etc. Whereupon it is ordered by the Court here that the
Said Joshua Cecell have Execution against the Said Richard Stevens for the Said
Sume of Seven hundred twenty Seven pounds of tobaccoe the Debt Confessed by
the Said Richard aforesaid etc.
Mr. Thomas Greenfeild and William Ray was Sworne Evidences for Hugh
Ryley against Major Nicholas Sawell etc.

planter was Attached to Answer unto Richard Marsham and Ann his wife Ad-
ministratrix of all and Singular the goods Chatties and Creditts of Henry
Brent who dyed Intestate etc. of a plea of trespass upon the Case etc.
And Whereupon the Said Richard and Ann by Cleborne Lomax their Attorney
Complaineth that whereas the Said William the twentith day of December in
the yeare of our Lord 1693 [279] Att Calvert County that is to Say at Charles
Towne within the Jurisdiction of this Court was Indebted unto the Said Henry
in his Life time in the Sume of Sixteen hundred fifty and Eight pounds of
tobaccoe being as well for Divers goods and Sundry parcells of of Lickquors by
the Said Henry to the Said William Sold and delivered as for Accomedations
and three barrells of Corne Lent as by a pertickeler Account thereof ready in
Court to be produced more at Large may Appeare And the Said William to the
Said Henry in manner aforesaid being indebted the Said William Inconsideration
thereof Did Assume upon himselfe and to the Said Henry then and there Faith-
fully promise that he the Said William the Said Sume of 1658 lbs. of tobaccoe to
the Said Henry when he Should be thereunto Requested would well and truly
Content and pay Nevertheless the Said William his promise and Assumption
aforesaid not Regarding but minding and Fraudulently Intending him the Said
