Henry in this behalfe Craftily and Subtilly to deceive and defraud the Said Sume
of 1658 lbs. of tobaccoe or any part thereof to the Said Henry in his Life time
hath not paid Nor to the Said Ann whilst She was Sole to whome Administration
of all and Singular the goods Chatties and Creditts which were of the Said Henry
at the time of his death in due forme of Law was Committed after the death of
the Said Henry Nor to the Said Richard and Ann Since the marryage between
them had and Solemnized nor to Either of them the Same hath not paid Al-
though the Said William to doe the Same by the Said Henry in his Life time
Afterwards the day and place aforesaid was Requested And by the Said Ann
Administratrix as aforesaid while Shee was Sole After the death of the Said
Henry Brent and by the Said Richard and Ann Since the marryage between them
had and Solemnized hath been Requested that is to Say the tenth day of November
in the yeare of our Lord 1696 but hath hitherto Refused and Still doth Refuse to
the dammage of the Said Richard and Ann of 3000 lbs. of tobaccoe and thereof
they bring their Suite etc.

And the Said Richard and Ann brings here into Court the Letters of Adminis-
tration by which etc.

The plantiffes by their Attorney aforesaid haveing Issued out a writt against
the Defendant And Likewise have Caused a Coppy of the above Decleration and
Account to be by the Sheriffe delivered to the Defendant at the time of the Serving
the Said writt which was Eight dayes before this Court Whereupon the Said plan-
tiffes by their Attorney prayeth that the Said Defendant to theire Decleration afore-
said this Court may Answer According to Act of Assembly in Such Cases made and
provided etc.

And the Said William Waford by John Meriton his Attorney Comes and de-
fends the aforesaid Force and Injury when etc. and for plea to the Said Action
pleads the Act of Limitation of [280] Certaine Actions for Avoiding Suites of
Law and thereof he prayeth Judgment of this Court: Meriton.

And the Said plantiffes by theire Attorney aforesaid Saith that they are not
barred of their Action aforesaid by the Said Act of Limitation pleaded and prays
