Debt is paid Whereupon the Defendant prayeth Leave that the [265] Court
here would Assigne Auditors to here and Adjust Accounts between the Said
plantiffe and Defendant According to an Ordinance of Assembly in Such Cases
made and provided etc. Whereupon the Court here doth Assigne Auditors (Viz.)
Mr. John Wighte and Mr. William Wilkinson to Audite and Adjust Accounts
between the partes aforesaid And that they make Report thereof to the next
Court to be held here the fourth Tuesday in January next etc.
Thomas Greenfeild Administrator of Richard Charlett plantiffe: Samuell
Warren Defendant.
The plantiffe by William Stone his Attorney brought his Majesties writt
against the Defendant in a plea of Debt for two thowsand two hundred forty
nine pounds of tobaccoe and the Said Defendant in his proper person Comes
and Defends the force and Injury when etc. And prayeth that the Court here
would Assigne Auditors to here and Adjust Accounts between the Said plantiffe
and Defendant the Said Defendant Alledging that a great part of the Said Debt
is already paid According to an Ordinance of Assembly in Such Cases made and
provided etc. Whereupon the Court here doth Assigne Auditors (Viz.) Mr.
John Wight and Mr. William Wilkinson to Audite and Adjust Accounts between
the parties aforesaid and that they make Report thereof to the next Court to
be held here the fourth Tuesday in January next etc.

The plantife by William Stone his Attorney bought his Majesties writt against
the Defendants in a plea of Debt for Eleven thowsand Eighty Seven pounds of
tobaccoe Debt And the Said Defendants Alledgeth that a grate part of the Said
Debt is paid and Sattisfied Whereupon the Said Defendants prayeth that
the Court here would Assigne them Auditors to here and Adjust Accounts be-
tween the Said parties According to An Ordinance of Assembly in Such Cases
made and provided etc. Whereupon the Court here doth Assigne Auditors
(Viz.) Col. Thomas Hollyday and Mr. David Small to Audite and Adjust Ac-
counts between the parties aforesaid and that they make Report thereof to the
next Court to be held here the fourth Tuesday in January next etc.
Henry Jowles plantiffe: John Henry Defendant.
The plantiffe brought his Majesties writt of Scire facias against the Defendant
for two hundred and Seaventy pounds of tobaccoe due to the plantiffe for
Clerks fees due to the plantiffe as he was formerly Clerke of Calvert County
Court as by a pertickeler Account thereof filed Appeareth etc. Whereupon it
was Command the Sheriffe that he make knowne to the Said Defendant to
Appeare before the Justices of our next County Court to be held at Charles
Towne the fourth Tuesday in November 1697 to Shew Cause if etc. why the
Said plantiffe his Execution against him of the Debt aforesaid ought not to have
etc. Att which Said Day the Sheriffe Returneth that he hath made knowne unto
the Said Defendant of his being here this day to Shew Cause if any etc. And
Whereupon the Said John Henry by himselfe in his proper person Comes and
Defends the force and Injury when etc. and Saith that he Cannot gainsay the
writt aforesaid but that he oweth the Said two hundred and Seaventy pounds
of tobaccoe in manner and forme aforesaid Therefore it is Considered that the
Said Henry Jowles have Execution against the Said John Henry of his Damages
