here untill the next Court and it is granted unto him the Same day is given to the
plantiffe etc. Att which Said next Court (to witt) the 28th day of September
Annoque Domini 1697 here Came as well the Said Edward and Dudly Carleton
as the Said Thomas Tracey by theire Attorneys aforesaid And the Said Edward
and Dudly Carleton prayeth that the Said Thomas Tracey to their Decleration
aforesaid may Answer etc. And the Said Thomas Tracey by John Meriton his
Attorney Cometh and defendeth the force and Injury when etc. And Saith that
hee is not informed by the Said Thomas Tracey his Clyant of any Answer for the
Said Thomas Tracey in the plea aforesaid to be given and nothing more thereof
Saith by which the Said Edward and Dudley Carleton Remaineth against the Said
Thomas Tracey thereof undefended etc.
Therefore it is Considered that the Said Edward and Dudley Carleton Recover
against the Said Thomas Tracey as well the Sume of Eight hundred Sixty two
pounds of tobaccoe their Damages in the premises aforesaid As alsoe the Sume of
three hundred thirty Six pounds of tobaccoe to the Said Edward and Dudley
Carleton at theire Request for their Costs and Charges in this behalfe Sustained
etc. by the Court here Adjudged etc. And the Said Thomas Tracey in mercy etc.
Charletts Administrator plantiffe: Robert Gates Defendant
Thomas Greenfeild Administrator of Richard Charlett brought the writt of
our Sovereigne Lord the King against Robert Gates of a plea of trespass upon the
Case etc.
And the Said Robert Gates in his proper person Came into Court and defend-
eth the force and injury when etc. And Alledged that hee hath an Account against
the Said Richard Charlett to barr the Account that hee is now Sued for etc. And
therefore prayeth that Auditors may be Assigned him to heare and Ajust
Accounts between him and the Said Administrator aforesaid etc. According to an
Ordinance of Assembly in that Case made and provided etc. And hereupon Audi-
tors Are Assigned him (Viz.) Mr. Richard Marsham and Mr. John Wighte who
by the Court was ordered to heare and Adjust Accounts betwen the parties afore-
said and that they make Report thereof to the next Court etc.
Att which Said next Court (to witt) the 28th day of September Annoque
Domini 1697 Came as well the Said Thomas Greenfeild by William Stone his
Attorney as the Said Robert Gates in his proper person And the Auditors afore-
said Likewise Came And made Returne of their Audite as followeth (Viz.) In
Observance of the Order of this Court wee have Stated the Account between
Mr. Charletts Administrator and Mr. Robert Gates and wee find there is Due to
Robert Gates the Sume of five hundred twenty two pounds of tobaccoe and
Eleven Shillings and Sixpence in money as wittness our hands the 25th day of
September 1697. Richard Marsham, John Wighte.
Therefore it is Considered that the Said Thomas Greenfeild take nothing by his
Said writt but be in mercy etc. And that the Said Robert Gates goe thereof
without Day etc.
[252] These five Actions are Agreed: Thomas Sands and Company against
William Groome - trespass on the Case; John Joyce against John Chapman -
trespass on the Case; Robert Coverthought against George Wade - trespass on the
Case; Randalph Garland against Matthew Mockeboy - trespass on the Case;
Richard Camera against William Dent - Debt 600.
These 25 Actions are Continued untill the next Court: Thomas Tench, Esq.,
against Robert Edmonsons Administrator - trespass on the Case; William Groome
