Edward and Dudley Carleton plantiffe: Thomas Tracey Defendant
Prince Georges County Ss. Thomas Tracey late of Prince Georges County
planter was Summoned to Answer unto Edward and Dudley Carleton of London
Merchants of a plea of trespass upon the Case etc.
And Whereupon the Said Edward and Dudley by William Stone his Attorney
Complaineth that whereas the Said Thomas the 29th day of August in the yeare
of our Lord 1696 Att Charles Towne within the Jurisdiction of this Court was
Indebted unto the Said Edward and Dudley the Sume of 862 lbs. tobaccoe upon
the ballance of Accounts as by a pertickeler Account thereof here in Court pro-
duced Relation being thereunto had may more at Large Appeare And the Said
Thomas to the Said Edward and Dudley in manner aforesaid being Indebted
Inconsideration thereof did Assume upon himselfe and to the Said Edward and
Dudley then and there faithfully promise that he the Said Thomas them the Said
Edward and Dudly the Said Sume of 862 lbs. of tobaccoe when he Should be
thereunto Requested would well and truly Content and pay Nevertheless the
Said Thomas his promise and Assumption Soe as aforesaid made Little Regarding
but minding and Fraudulently intending them the Said Edward and Dudley in
this behalfe Craftily and Subtilly to deceive and defraud the Said Sume of Eight
hundred Sixty two pounds of tobaccoe to them the Said Edward and Dudley or
to Either of them hath not paid Although the Said Thomas to doe the Same by
the Said Edward and Dudley Afterwards the day and place aforesaid was often
thereunto Requested but the Same to pay hath hitherto denyed and Still doth
denye to the damage of the Said Edward and Dudley of 1500 lbs. of tobaccoe and
thereupon they bring their Suite etc.
