SEPTEMBER, 1697 COURT 257

would prove him (meaning the Said Thomas Hollyday) to be Soe meaning a
foole and a Rogue when as indeed the Said Thomas never was ever guilty of any
Roguery or Villany whatsoever neither is the Said Thomas an Ideot or foole
but a person whome his Majesty has Assigned to Administer Justice well know-
ing and Understanding him Capable thereof which words are tending to the
disturbance of the Kings peace and in Contempt of his Crowne and dignity
and alsoe against the forme of the Stattute in that Case made And provided.

William Bladen Clerk of the Crowne and Domini Regis.

Mr. Thomas Hollyday, David Small, James Stoddart, Henry Bonner and
Josias Towgood all Sworne as Evidences for his Said Majesty and Sent to the
grand Jury to Informe etc.

On the back of aforesaid bill of Indictment was Endorsed (Billa Vera) James
Moore foreman.

And now here at this day (that is to Say) the twenty Eight day of September
Annoque Domini 1697 this Same Court before the Justices of our Sovereigne
Lord the King at Charles Towne aforesaid Came here Hugh Ryley in the
Custody of the Sheriffe And being brought to the barr here in his propper
person It was by the Court here Demanded of the Said Hugh Ryley [235]
How hee would Acquit himselfe of the premises before Imposed upon him.
And the Court here further Demanded of the Said Hugh Ryley if he would
have Councill Assigned to plead for him but he Refused etc. But the Said
Hugh Ryley in his proper person Saith that hee doth Submit to the Judgment
of this Court. Whereupon it is ordered by the Court here that the Said Hugh
Ryley Remaine in the Custody of the Sheriffe untill he finds good Security for
his good Behavour and Appearance the next Court etc.

And now here at this day (to witt) the 28th day of September Annoque
Domini 1697 Came the Said Hugh Ryley and Acknowledged himselfe to be
Indebted unto our Sovereigne Lord the King in the Sume of twenty pounds
Lawfull money of England together with Martin Falkner and Christopher
Thompson his Sureties And the Said Martin Falkner did Acknowledge himselfe
Indebted to the Said Sovereigne Lord the King in the Sume of tenn pounds of
Like mony And the Said Christopher Thompson in the Sume of tenn pounds
Like mony to be Leavied of their goods and Chatties Lands and tennements
Respectively for his Majesties use etc. If the Said Hugh Ryley Shall not Appeare
at the next County Court to be held here the fourth Tuesday in November next
And in the meane time be of good Abearence as well towards his Majesty as all
the good people of this Province And Espetially towards Mr. Thomas Hollyday.

And now here att this day (that is to Say) the 28th day of September Annoque
Domini 1697: this Same Court before the Justices of our Sovereigne Lord the
King att Charles Towne aforesaid Came here Joshua Hall in the Costody of the
Sheriffe and brought to the barr here in his proper person It was Demanded
the Said Joshua Hall by the Court here how he would Acquitt himselfe of the
premises before imposed upon him etc. And the Said Joshua Hall in his proper
person Saith that he doth Submitt himselfe to the Judgment of this Court.
Whereupon it is ordered by the Court here that the Said Joshua Hall Remaine
in the Custody of the Sheriffe untill he finds good Security for his good behavour
and Appeareance the next Court, etc.

And now here at this day (to witt) the 28th day of September Annoque
Domini 1697 Came here as well the Said Joshua Hall and Acknowledged] him-
