plantiffe Likewise. Att which Said next Court (to witt) the 24th day of August
Annoque Domini 1697: here Came as well the Said William Creed as the Said
George Plowden by their Attorneys aforesaid and the Said William Creed prayeth
that the Said George Plowden to his Decleration aforesaid may Answer etc. And
the Said George Plowden by John Meriton his Attorney further Cometh and de-
fendeth the force and Injury when etc. And Saith that he is not Informed by the
Said George Plowden his Clyant of any answer for the Said George Plowden in
the plea aforesaid to be given and nothing more thereof Saith by which the Said
William Creed Remaineth against the Said George Plowden thereof undefended
etc. Therefore it is Considered that the Said William Creed Recover against the
Said George Plowden the Sume of three hundred thirty two pounds of tobaccoe
his debt aforesaid and his Damages by Occation of Detaining the Said Debt
to two hundred and Eighty pounds of tobaccoe to the Said William Creed of his
Assent by the Court here Adjudged etc. And the Said George Plowden in mercy
etc.
James Martin plantiffe: Ninian Beall Defendant
Prince Georges County Ss. Ninian Beall late of Prince Georges County gentle-
man Otherwise Called Ninian Beall of Prince Georges County and province above-
said gentleman was Sumoned to Answer unto James Martin of a plea that he
Render unto him the full and Just Sume and neate quantity of two thowsand
Seven hundred Eighty and one pounds of good Sound leafe tobaccoe Cleare from
ground leaves and all manner of trash whatsoever which to him he oweth And
from him unjustly Deteyneth etc.
[220] And whereupon the Said James Martin by James Cranford his Attorney
Saith that whereas the Said Ninian the 23d day of June Annoque Domini 1696
did owe and Stand firmly bound and Justly Indebted unto James Martin of
Calvert County and province aforesaid Merchant in the full and Just Sume and
neat quantity of two thowsand Seaven hundred Eighty and one pounds of good
Sound leafe tobaccoe cleare from ground Leaves and all manner of trash whatso-
ever and Caske to Containe the Same to be paid Convenient in Pattuxent River
to the Said James Martin him his heires Executors Administrators or Assignes
upon all Demands and for the which payment well and truly to be made and
done he the Abovesaid Beall bound himselfe his heires Executors and Adminis-
trators and Assignes firmly by those presents Nothwithstanding which the Said
Ninian the Said Sume of 2781 lbs. of tobaccoe to the Said James Martin to pay
hath not Although often thereunto Required but the Same to pay hath denyed
and Still doth denye to the Dammage of the plantiffe 4000 lbs. of tobaccoe and
thereupon he brings his Suite.
Pledges to procecute John Doe, Richard Roe. James Cranford for the
Querens.
And the Said Ninian Beall by John Meriton his Attorney Cometh and De-
fendeth the force and Injury when etc. And prayeth Leave thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given to
the plantiffe Likewise.
