feild, Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne Doe Say upon their oath that they find for the plantiffe.
Then Came John Garrett And Appealed to the Provintiall Court and for the
due procecution of the Same brought into open Court Thomas Hatton and
William Bladen who Acknowledged this Recognizance Following (Viz.)
Thomas Hatton and William Bladen Acknowledged themselves bound unto
John Davis in the Sume of three thowsand Six hundred Sixty four pounds of
tobaccoe to bee Leavyed on their goods and Chatties Lands and tenements to and
for the use of the Said John Davis upon this Condition that if the Said John
Garrett Shall at the Provintiall Court now next Ensueing procecute the directions
of an Act of Assembly of this province Entituled an Act for Appeales and Regu-
lateing writts of Error) According to the Rules of the Provintiall Court and
procecute his Appeale with Effect and Alsoe Sattisfie and pay unto the Said
John Davis his heires Executors Administrators or Assignes in Case the Judgment
now given against the Said John Garrett Shall be Affirmed as well the Damages
and Costs Adjudged by the aforesaid verdict as alsoe all Costs and Damages that
Shall be awarded by the Provintiall Court for the delaying of Execution that then
this Recognisance Shall be voyd and of no Effect otherwise to Stand and be in
full force and Vertue.
William Creed plantiffe: George Plowden Defendant
Prince Georges County Ss. George Plowden late of Prince Georges County
otherwise Called George Plowden of Calvert County in the province of Maryland
[219] Planter was Sumoned to Answer unto William Creed of a plea that he
Render unto him the full Sume and Just quantity of three hundred and thirty
two pounds of good Sound Marchantable tobaccoe and Caske which to him he
oweth and Unjustly Deteyneth etc.
And whereupon the Said William by William Stone his Attorney Saith that
whereas the Said George the 19th day of March in the yeare of our Lord 1695
[1696] Att Calvert County that is to Say att Charles Towne within the Jurisdic-
tion of this Court by his Certaine bill Obligatory which the Said William with
the Scale of the Said George Signed bringeth here into Court the date whereof
is the Same day and yeare aforesaid the Said George by the Said bill Obligatory
did bind himselfe his heires Executors and Administrators to pay or Cause to be
paid unto the Said William Creed his heiies Executors Administrators or Assignes
the full Sume and Just quantity of three hundred and thirty two pounds of good
Sound Marchantable tobaccoe in Caske Convenient in Calvert County aforesaid
upon Demand after the tenth day of October next Ensueing the date of the
Said bill Obligatory Notwithstanding which the Said George the Said Sume of
332 lbs. of tobaccoe in Caske According to the tennor of the Said bill Obligatory
Although Often demanded hath not paid but the Same to pay to the Said
William hath denyed and Still doth denye to the damage of the Said William
of 600 lbs. of tobaccoe and thereupon he brings his Suite etc.

And the Said George Plowden by John Meriton his Attorney Cometh and cle-
fendeth the force and Injury when etc. And prayeth leave thereof to Imparle here
untill the next Court and it is granted unto him the Same day is given to the
