over the Said Potomock River into Virginia one Daniell Troy not haveing any
pass as aforesaid lately a Freeman and a dweller in this County of Prince George
which Said Daniell Troy att the time of his Departure out of this County of
Prince George and at the time aforesaid that he the Said John Garrett did trans-
port and Convey the Said Daniell Troy in his the Said John Garretts boate over
Potomock River into Virginia did Stand Justly Indebted unto the Said John
Davis in the Sume of Eighteen hundred thirty two pounds of tobaccoe being Soe
much tobaccoe due from the Said Daniell Troy unto the Said John Davis by
Account for a horse Saddle and bridles as by a pertickeler Account thereof here
in Court produced dated the 20th day of September in the yeare of our Lord
1696 Relation being thereunto had may more at Large Appeare And Soe the Said
John Davis the Said Sume of 1832 lbs. of tobaccoe due from him the Said
Daniell Troy as aforesaid by meanes of the Said John Garretts transporting and
Conveying the Said Daniell Troy over Potomock River into Virginia as afore-
said hath utterly Lost as to any Recovery against the Said Daniell Troy or any
otherwise Excepting by force of the Said Act of Assembly against the Said John
Garrett in Contempt and Dispight of which Said Act of Assembly the Said John
Garrett the Said Daniell Troy did transport and Convey over Potomock River
into Virginia in a boate of his the Said John Garrett as aforesaid by which Action
to the Said John Davis doth Accrue to have and Requier of the Said John
Garrett the Said Sume of 1832 pounds of tobaccoe Yett the Said John Garrett the
Said Sume of 1832 pounds of tobaccoe to him the Said John Davis Although often
thereunto Required hath not Rendered nor any Sattisfaction [218] For the
Same made but the Same to Render or Sattisfie to the Said John Davis hath
denyed and Refused and Still doth denye and Refuse the Same to the Damage
of the Said John Davis of 3600 lbs. of tobaccoe and thereupon he brings this
Suite etc.

And the Said John Garrett by William Bladen his Attorney Cometh and de-
fendeth the force and Injury when etc. and Craveth Lycence thereof to Imparle
here untill the next Court and it is granted unto him the Same day is given to
the plantiffe Likewise.

Att which Said next Court (to witt) the 24th day of August 1697. Came here
as well the Said John Davis as the Said John Garrett by their Attorneys Aforesaid
and the Said John Davis prayeth that the Said John Garrett to his Decleration
aforesaid may Answer etc.

And the Said John Garrett by William Bladen his Attorney Cometh and De-
fendeth the force and Injury when etc. And Saith that he is not guilty of the
breach of the Act of Assembly in manner and forme as the plantiffe in his
Decleration aforesaid hath Complained and of this he putts himselfe upon the
Country.

Therefore it is Comanded the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. and who neither etc. to Recognize etc. because as
well etc. And now here at this day (to witt) the 24th day of August Annoque
Domini 1697: here Cometh as well the Said John Davis as the Said John Garrett
by theire Attorneys aforesaid And the Jurors thereon Impanelled being Called
Likewise Came (Viz.)
