and Sixteen pounds of tobaccoe to the Said Thomas Greenfeild Administrator
aforesaid at his Request for his Costs and Charges in this behalfe laid out and
Expended etc. And by the Court here Adjudged etc. And the Said Thomas Davis
in mercy etc.
Thomas Greenfeild Administrator of Richard Charlett plantiffe: William
Hill Defendant.
The plantiffe by William Stone his Attorney Sues the Defendant in a plea
of Debt for one thowsand ninty Eight pounds of tobaccoe due by bill etc.
The Defendant by James Cranford his Attorney in open Court made itt
Appeare that the Said Defendant had paid the Said Richard Charlett in his
lifetime the Sume of four hundred and thirty pounds of tobaccoe two hundred
ninty Eight pounds of which was due to the Said Richard Charlett by Account
and the Remaining part of the Said four hundred and thirty pounds of tobaccoe
being one hundred thirty two lbs. of tobaccoe was paid to the Said Richard
Charlett in part of payment of the above bill Sued for the Sume of one
thowsand ninty Eight pounds of tobaccoe etc.
But as to the Sume of nine hundred Sixty Six pounds of tobaccoe the Re-
maining part of the Said bill of one thowsand ninty Eight pounds of tobaccoe
Sued for the Said William Hill and his Attorney Cannot Gainesay but that the
Same is Still due and owing in manner and forme as the plantiffe against him
doth Complayne etc.
Therefore it is Considered that the Said Thomas Greenfeild Administrator
of the goods and Chatties of Richard Charlett Deceased Recover against the Said
William Hill as well the Sume of nine hundred Sixty Six pounds of tobaccoe
the ballance of the bill aforesaid as alsoe the Sume of two hundred and Sixteene
pounds of tobaccoe to the Said Thomas Greenfeild Administrator aforesaid at
his Request for his Cost and Charges in this behalfe Laid out and Expended etc.
And by the Court here Adjudged etc. And the Said William Hill in mercy etc.

Marrener was Attached to Answer unto John Forrest of a plea of trespass upon
the Case etc.
And Whereupon the Said John Forrest by William Stone his Attorney Com-
playneth that whereas the Said Samuell Gibbs the 16th day of August in the
yeare of our Lord 1694 at Calvert County that is to Say at Charles Towne
within the Jurisdiction of this Court was Indebted unto the Said John in the
Sume of four pounds Eight Shillings Sterling being for a Steere and a hogg
Sold and delivered him and the Said Samuell to the Said John in manner afore-
said being Indebted inconsideration thereof the Said Samuell did Assume upon
himselfe and to the Said John then and [178] there faithfully promise that
he the Said Samuell him the Said John the Said Sume of four pounds Eight
Shillings Sterling when he Should be thereunto Requested would well and truly
Content and pay Nevertheless the Said Samuell his promise and Assumption
soe as aforesaid made Little Regarding but minding and Fraudulently intending
him the Said John in this behalfe Craftily and Subtilly to deceive and defraud
the Said Sume [of] four pounds Eight Shillings or any part thereof to the Said
John hath not paid Although the Said Samuell to doe the Same by the Said
John Afterwards the day and the place aforesaid was often thereunto Requested
but the Same to pay hath hitherto denyed and Still doth denye to the damage
