The plantiffe by his Attorny haveing Issued out a writt against the Defendant
which Said writt was by the Sheriffe Returned that the Said Defendant was
not to be found in his balywick and Likewise have Caused a Coppy of the
Decleration to be left at the house where the Defendant last Lived in this
County And Likewise it is testified here in Court on part of the plantiffe that
the Said Defendant hath Eloined himselfe out of the Jurisdiction of this Court
Whereupon the Said Charles Tracy by Cleborne Lomax his Attorney prayeth
an Attachment against the goods Chatties and Creditts of the Said Richard as
well for the Said Sume of one thowsand twenty Seaven pounds of tobaccoe the
Debt for Damages due by Account abovsaid as alsoe the Sume of four hundred
Sixty Six pounds of tobaccoe his the Said Charles Traceys Costs and Charges in
this behalfe Laid out and Expended etc. and by the Court here it is granted
unto him etc.
Charlets Administrators plantiffe: Thomas Sprigg and John Sprigg Defendant.
Thomas Greenfeild the plantiffe by William Stone his Attorney Came here
into Court and Levyed here his plaint against Each of the Defendants in a plea
of trespass upon the Case etc.
Therefore it was Commanded the Sheriffe that he take them etc. if etc. and
that hee may have them etc. at the next Court to be held here the 4th Tuesday
in June 1697.
And the Sheriffe now Returneth that he hath taken the bodyes of the Said
Thomas Sprigg and John Sprogg etc.
And because the Sheriffe hath not here the bodyes of the Said Thomas Sprigg
and John Sprigg therefore the Said Sheriffe in Misericordia etc.

Davis Defendant.
The plantiffe by William Stone his Attorney Sues the Defendant in a plea
of Debt for two thowsand forty Six pounds of tobaccoe due by bill etc.
The Defendant in his proper person Came into open Court and made it
Appeare to the Court here that he had paid the Said Richard Charlet in his life
time one thowsand and Eighty two pounds of tobaccoe nine hundred and forty
pounds of which was paid to Sattisfie an Account due from the Said Thomas
Davis to the Said Richard Charlett and the Remaining part of the Said one
[177] Thowsand Eighty two pounds of tobaccoe being one hundred forty two
pounds of tobaccoe being in part of the Said bill Sued for the Sume of two
thowsand forty Six pounds of tobaccoe etc. But as to one thowsand nine
hundred and four pounds of tobaccoe the Remaining part of the Said bill of
two thowsand forty Six pounds of tobaccoe Sued for the Said Thomas Davis
Cannot gainsay but that he Still oweth the Same in manner and forme as the
plantiffe against him doth Complayne etc.
Therefore it is Considered that the Said Thomas Greenfeild Administrator
of the goods and Chatties of Richard Charlett Recover against the Said Thomas
Davis as well the Sume of one thowsand nine hundred and four pounds of
tobaccoe the ballance of the bill aforesaid as alsoe the Sume of three hundred
