JANUARY, 1696/7 COURT 153
Aprill the 11th 1696: Then Came before us Edward Fenix and made oath
that the above Account is Just and true and that hee Never Received part nor
parcell no more than Creditt given.
Sworne before us Thomas Brooke, Thomas Greenfeild.
And the Said Hugh Furguson by William Stone his Attorney Cometh and
defendeth the force and Injury when and etc. and Craveth Lycence thereof to
Imparle here untill the next Court and it is granted unto him the Same day
is given to the plantiffe Likewise etc.
Att which Said next Court (to witt) the 26th day of January Annoque Domini
1696 [1697] Came the aforesaid parties by their Attorneys aforesaid and the
Said Edward Phenix prayeth that the Said Hugh Furguson to his Decleration
aforesaid may Answer etc.
And now here at this Day Came the Said Hugh Furguson by William Stone
his Attorney and further defendeth the aforesaid force and Injury when etc. And
saith that [137] The said Hugh Furguson did not Assume upon himselfe in
manner and forme as the plantife in his Decleration aforesaid hath Complained
against him and of this he puts himsellfe upon the Country. William Stone.
And the plantiffe alsoe: Cleborn Lomax.
Therefore it is Commanded the Sheriffe that without delay he cause to Come
here twelve etc. by whome etc. And who neither etc. to Recognize etc. because
as well etc. And now here at this day Came the aforesaid partes by their
Attorneys aforesaid And the Jurors thereon Impannelled being Called Likewise
Came (Viz.)
James Stoddart, foreman, John Pottinger, Archable Edmonson, Morreen
Devall, Joseph Harryson, John Sprigg, Charles Beall, John Davis, John Dosset,
Thomas Prather, John Gardiner, Robert Biggs, Sumoned per Thomas Green-
feild, Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne doe Say upon their oaths that the Said defendant doth owe to the Said
plantiffe the Sume of two thowsand one hundred and ninty pounds of tobaccoe
part of the Said Sume in the plantiffes decleration aforesaid mentioned.
Therefore it is Considered that the Said Edward Fenix Recover against the
Said Hugh Furguson as well his Damages in the premises to two thowsand one
hundred and ninty pounds of tobaccoe by the Jurors aforesaid Assesed in forme
aforesaid as alsoe the Sume of nine hundred Eighty Six pounds of tobaccoe to
the Said Edward Fenix at his Request for his Cost and Charges in this behalfe
Sustained by the Court here Adjudged etc. And the Said Hugh Furguson in
mercy etc.
Henry Jowles plantiffe: Jacob Bourneveetch Defendant.
The plantiffe Sues the Defendant for four thowsand Six hundred and nine-
teene pounds of tobaccoe a Certaine Debt due by bill as by Decleration and bill
filed Appeareth. The Defendant in his proper person Cometh and Defendeth
the force and Injury when etc. and Craveth Lycence thereof to Imparle here
untill the next Court and it is granted unto him the Same day is given to the
plantiffe alsoe.
Att which Said next Court (to witt) the 26th day of January Annoque
Domini 1696[1697] Came the Said Henry Jowles by his Attorney and prayeth
that the Said Jacob Bourneveetch to his Decleration aforesaid may Answer etc.
