George Athey his Clyent of aney Answer for him in the plea aforesaid to be
given and nothing more thereof Saith by which the Said Thomas Hussey Re-
maineth against the Said George Athey thereof undefended etc.

Therefore it is Considered that the Said Thomas Hussey Recover against
the Said George Athey the Sume of nine hundred and four pounds of tobaccoe
his Debt aforesaid and his [136] Damages by occation of Deteyning of the Said
Debt to two hundred Seaventy nine pounds of tobaccoe to the Said Thomas
Hussey of his Assent by the Court here Adjudged and the Said George Athey in
mercy etc.

Edward Fenix plantiffe: Hugh Furguson Defendant.

Prince Georges County Ss. Hugh Furguson late of Prince Georges County
Chyrurgion was Atteched to Answer unto Edward Phenix of a plea of trespass
upon the Case etc.

And whereupon the Said Edward by Cleborn Lomax his Attorney Com-
plaineth that whereas the Said Hugh the Eleaventh day of Aprill 1696 at Charles
Towne within the Jurisdiction of this Court was Indebted unto the Said
Edward in the Sume of three Thowsand Eight hundred ninty and one pounds
of tobaccoe being as well for one years Accomedations of him the Said Hugh
and his boy as for tobaccoe Assumed by the Said Hugh to pay to the Said
Edward for one Joseph Hopewell as for Severall goods by the Said Edward
to the Said Hugh Sould and delivered as by a pertickeler Accompt thereof
here ready in Court to be produced more at large may Appeare And the Said
Hugh to the Said Edward in manner aforesaid being Indebted the Said Hugh
inconsideration thereof did Assume upon himselfe and to the Said Edward
then and there faithfully promise that he the Said Hugh the Said Sume of
3891 lbs. of tobaccoe to the Said Edward when he Should be thereunto Re-
quested would well and truly Content and pay and Although he the Said Hugh
hath paid and Sattisfied to the Said Edward the Sume of 800 lbs. of tobaccoe
part of the Said 3891 lbs. of tobaccoe Yet the Said Hugh his promise and
Assumption aforesaid to 3091 lbs. of tobaccoe not regarding but minding and
fraudulently Intending him the Said Edward in this behalfe Craftily and Sub-
tilly to deceive and defraud the Said Sume of 3091 lbs. of tobaccoe to the Said
Edward hath not paid Although the Said Hugh to doe the Same by the Said
Edward Afterwards the day and place aforesaid was Requested but hath hitherto
Refused and Still doth Refuse to the damage of the Said Edward of five
thowsand pounds of tobaccoe and thereof hee bringeth his Suite etc.
