140 PRINCE GEORGES COUNTY

Court and it is granted unto him the Same day is given to the plantiffe Likewise
etc.

Att which Said next Court to witt the 26th day of January 1696 [1697] Came
the Said plantiffe by his Attorney aforesaid but the Said defendant Either by
himselfe or his Attorney Although Sollemly Called Came not but made default.

Therefore it is Considered by the Court here that the Said Samuell Goosey
Recover against the Said Daniell Troy as well the Said Sume of four hundred and
fifty pounds of tobaccoe his debt due by bill as aforesaid as alsoe the Sume of
two hundred and twenty pounds of tobaccoe to the Said Samuell Goosey of his
Assent for his Cost and Charges in this behalfe Laid out and Expended by the
Court Adjudged etc. And the Said Daniell Troy in mercy etc.

Teague Trasey plantiffe: Daniell Smith Defendant.

The plantiffe by William Stone his Attorney Sues the defendant for one thow-
sand four hundred pounds of tobaccoe due by bill as by Decleration and bill
filed Appeareth.

The defendant by Cleborn Lomax his Attorney Cometh and defendeth the
force and Injury when etc. and prayeth Lycence thereof to Imparle here untill
the next Court and it is granted unto him the Same day is given to the plantiffe
Likewise etc.

Att which Said next Court to witt the 26th day of January 1696 [1697] Came
the Said parties by their Attorneys aforesaid and the Said plantiffe prayeth that
the Said Defendant to his Said Action aforesaid may Answer etc. And the Said
defendant by his Attorney aforesaid Cometh and defendeth the force and Injury
when etc. And Saith that he Cannot gainsay the Action of the Said plantiffe nor
but the Said bill Obligatory is the deed of the Said Daniell Smith nor but that
he oweth the Said one thowsand four hundred pounds of tobaccoe to the Said
plantiffe in manner and forme as the Said plantiffe against him hath Set fourth
etc.

Therefore it is Considered that the Said Teague Trasey Recover against the
Said Daniell Smith the Sume of one thowsand four hundred pounds of tobaccoe
his debt aforesaid And his Damages by Occation of Deteyning of the Said Debt
to two hundred twenty four pounds of tobaccoe to the Said Teague Trasey of
his Assent by the Court here Adjudged And the Said Daniell Smith in mercy etc.

Samuell Harwood plantiffe: Hugh Ryley Defendant.

The plantiffe yesterday Moved in Arrest of Judgment and prayed time untill
today to Shew his Reasons in the Same. [The try all in folio 111: and 112.]

And now here Came the Said parties by their Attorneys and it was demanded
of the plantiffe by the Court here to produce his Reasons but the Said plantiffe
and his Attorney made default and did not produce any Reasons for which they
Moved in Arrest of the Said Judgment.

Therefore it is Considered by the Court here that the Judgment aforesaid bee
Affirmed.

Ninian Beall, Richard Marsham and Walter Willett Sworne as Evidences for
Hugh Furguson and Thomas Teague against Christopher Thompson.

Jane Nicholls and William Scott Sworne as Evidences for Christopher Thomp-
son at the Suite of Hugh Furguson and Thomas Teague.

The Court Adjournd untill to morrow morning 8 a Clock.
