deceive and defraud the Said Sume of 1600 pounds of tobaccoe or any part
thereof hath not paid Although the Said Christopher to doe the Same by them
the Said Hugh and Thomas Afterwards the 15th day of October 1693 and at
Severall other dayes and times was often thereunto Requested but the Same to
pay hitherto Refused and Still doth Refuse to the Damage of them the Said
Hugh and Thomas of 3000 lbs. of tobaccoe and thereupon they bring their
Suite etc.

And the Said Christopher Thompson by Cleborn Lomax his Attorney Cometh
and defendeth the fource and Injury when etc. and Craveth Lycence thereof to
Imparle here untill the next Court and it is granted unto him the Same day is
given to the plantiffs Likewise etc.
Att which Said next Court to witt the 26th day of January 1696 [1697] came
here as well the Said Hugh Furguson and Thomas Teague as alsoe the Said
Christopher Thompson by their Attorneys aforesaid and the Said Hugh and
Thomas prayeth that the Said Christopher to their decleration aforesaid may
Answer etc. And now here at this day Came the Said Christopher Thompson by
Cleborn Lomax his Attorny and further defendeth the aforesaid force and Injury
when etc. And Saith that the Said Christopher Thompson did not Assume upon
himselfe in manner and forme as the plantiffs in their Decleration aforesaid hath
Complained against him and of this he putts himselfe upon the Country.

Therefore it is Commanded the Sheriffe that without delay he Cause to Come
here twelve etc. by whome etc. And who neither etc. to Recognize etc. because
as well etc. and now here at this day Came as well the Said Hugh Furguson and
Thomas Teague as the Said Christopher Thompson by their Attorneys aforesaid
And the Jurors thereon Impaneled being Called Likewise Came (Viz.)
James Stoddart foreman, Henry Dreyden, Edward Fenix, Morreen Devall,
Joseph Harryson, John Sprigg, Charles Beall, John Davis, John Dossett,
Thomas Prather, John Gardiner, Robert Biggs. Sumoned per Thomas Green-
feild Sheriffe.
Who to Speake the truth Conserning the premises being Elected tryed and
Sworne doe Say upon their oaths that they find for the Defendant.
Therefore it is Considered that the Said Hugh Furguson and Thomas Teague
take nothing by their Said writt but be in mercy for their false Clamor And the
Said Christopher Thompson goe thereof without day etc. Itt is Likewise Con-
sidered that the Said Christopher Thompson Recover against the Said Hugh
Furguson and Thomas Teague his Damages by Occation of the premises to four-
teen hundred fifty Seaven pounds of tobaccoe to the Said Christopher Thompson
by the discretion of the Justices here at his Request for his Cost and Charges in
this behalfe Sustained According to the forme of the Stattute etc. by the Court
here Adjudged etc.

The plantiffe by Cleborn Lomax his Attorney Sues the Defendant for four
hundred and fifty pounds of tobaccoe due by bill as by Decleration and bill filed
Appeareth etc.
