SEC. 15. Be it enacted, That this act shall take effect
from the date of its passage.

CHAPTER 34.

 

AN ACT to require the Clerk of the Circuit Court
for Frederick county to transcribe two equity
dockets of the Circuit Court for said county.

 

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Clerk of the Circuit Court for
Frederick county, State of Maryland, be and he is
hereby required and directed to procure two new
equity dockets, well bound and suitable for the pur-
pose, and transcribe therein in a fair, plain and legi-
ble hand, all the entries in the equity dockets of said
Circuit Court, numbered three and four, with correct
indexes of the same; said new and transcribed equity
dockets shall be respectively numbered three and
four, and when finished, completed, compared and
ascertained to be absolutely correct, said clerk shall
attach his certificate thereto of the correctness of the
copy, and from that time they are hereby declared
to be substituted in the place and stead of said orig-
inal dockets numbered three and four, and shall be
as valid, and have the same effect in all and every
respect, as if they were the original dockets.

SEC. 2. And be it enacted, by the authority aforesaid,
That the costs of said new books shall be paid by the
County Commissioners of Frederick county, and
the cost of transcribing said dockets shall be paid

vided, however, if there be no surplus proceeds, or
a deficiency of the same, then the county commis-
sioners of said county shall pay the same, or any part
thereof remaining unpaid out of the surplus; but in
