LAWS OF MARYLAND.

 

turnouts, if deemed necessary, shall be constructed at
convenient points to enable vessels to pass each other;
but nothing herein contained shall be so construed
as to hinder or prevent said corporation from enlarg-
ing said canal in depth and width if they so desire.

Exclusive use
of.

SEC. 11. And be it enacted, That in consideration
of the great risk, and expense of the said corporation
in building and keeping up the bridge or bridges,
hereinbefore provided for, and in digging and tilling
said canal for navigation as aforesaid, the corporation
is hereby granted the exclusive use of the bridge or
. bridges referred to, as wharves, or stopping places
for their steamers, vessels and other river craft, and
to grant the use of them to others on such terms as
they may determine, and the sole and exclusive right
to construct, fix and control for their benefit, gran-
aries, wharves and landings on either side of said
canal as they may deem necessary, for the embarking
and landing of passengers and the shipment, lauding
and storage of freight, merchandise, &c.

Demand and
receive.

SECTION 12. And be it enacted, That it shall be law-
ful for said corporation to demand and receive such
reasonable tax or toll as they may from time to time
agree on, and require of the owner or owners and
agents of all steamers, vessels and other craft, passing
through or sailing upon or making use of the said ca-
nal, when the same shall have been cut and opened to
navigation; which rates or. tolls shall always be made
public, and shall not be changed oftener than once
a year, and shall be a lien on any steamer, vessel or
craft incurring the same, until paid and discharged.

Location.

SEC. 13. And be it enacted, That the route of said
canal shall be located within one year, from the pass-
age of this act, and the work of construction shall be
actually commenced within two years from the pass-
age of this act, or the corporation hereby created
shall thereupon terminate, and all the right here-
under shall thereupon cease.

Reserved.

SEC 14. And be it enacted, That the General As-
sembly of Maryland reserves to itself the right to
amend or repeal this act.
