their annual exhibition, within the distance of two
|
 
|
|
and one-half miles of the fair grounds owned or
|
 
|
|
leased by said society, and any person found violat-
|
 
|
|
ing this law, it shall be the duty of any one of the
|

constables, the Sheriff of Kent county, or any one
|

of the special police appointed in another section of

this act, and forthwith to carry such person so vio-
|
 
|
|
lating as aforesaid, before the nearest justice of the
|

peace, who shall forthwith proceed to examine said
|
 
|
|
case on the part of the State, and if the proof so
|
 
|
|
justifies, he shall require the party so arrested to
|
 
|
|
give good and sufficient security for his appearance
|
 
|
|
to the next jury term of Kent county, and on failure
|
 
|
|
to give such security, said party shall forthwith be
|
 
|
|
committed to the jail of the county.
|
 
|
|
SEC. 2. And be it enacted, That every person found
|
 
|
|
guilty by the Circuit Court for Kent county of vio-
|
 
|
|
lating the provisions of this law, shall for the first
|

offence be fined by said court not less than fifty,
|
 
|
|
nor more than two hundred dollars, and for a subse-
|
 
|
|
quent offence against the provisions of this law, shall
|
 
|
|
in addition to the fine herein contained, be sent by
|
 
|
|
said court to the county jail for a period of thirty
|
 
|
|
days.
|
 
|
|
SEC. 3. And be it enacted, That the President and
|
 
|
|
Managers of said Kent County Agricultural Society
are hereby authorized and empowered to appoint
|

such number of persons as they may think necessary
|
 
|
|
to act as a special police during the annual exhibi-
|
 
|
|
tion of said society, and the persons so appointed
|
 
|
|
shall have full power to arrest any person found
|
 
|
|
violating the provisions of this act, or any criminal
|
 
|
|
law of this State, in or about said fair grounds dur-
|
 
|
|
ing the exhibition thereof.
