CHAPTER 185.

AN ACT to authorize the County Commissioners of Worcester County to erect and maintain abridge over Ayers Creek in said county, and to levy a sum of money therefor.
|
|
Authorized to erect bridge.
|
SECTION 1. Be it enacted by the General Assembly of Maryland, That the County Commissioners of Worcester county, be and they are hereby authorized and empowered to erect and maintain a bridge, suitable for the passage of teams with wagons, over the waters of Ayers Creek in the third election district in said county, on the route of a road proposed to be made from Berlin across said creek to South Point, and also to levy upon the taxable basis of said county a sum of money sufficient for that purpose, and for any damage that may be determined to be due to any

person by the erection and maintenance of said bridge; provided that if the commissioners aforesaid in their discretion, shall cause said bridge to be erected they shall make and keep up said bridge at least four feet above the water of said creek at ordinary high, tide, for one-third of the length of said bridge, and shall also prepare and keep a landing, not less than one hundred feet square on the northwest side of said creek, below and adjacent to said bridge; and also provided that nothing in this act

Be construed.

shall be construed to take away any right of action for damage done real estate bordering on said creek by reason of the erection and maintenance of said bridge; but no person shall recover any damage therefor, unless action for the same shall be instituted within ninety days from the completion of said bridge.
