Penalty.
|
SEC. 173. Any person who shall sell or barter any intoxicating, spirituous or fermented liquor, without first having obtained a license, as required by this act. shall, upon indictment and conviction. therefor, be fined not less than one hundred dollars nor more than three hundred dollars, and it shall be the duty of any justice of the peace, upon information received and confirmed by the oath of a credible witness, to have any person so offending, arrested and committed to the county jail, unless he shall give sufficient bail or recognizance, with sureties to appear before the circuit court at the next succeeding term thereof, to answer the charge.

SEC. 174. The provisions of this act shall not apply to sales by the manufacturer of cider which is not drunk on the premises of the manufacturer, nor to sales of spirituous or fermented liquors by the manufacturer thereof to any person licensed to sell intoxicating liquor in Worcester county.

Shall be liable
|
SEC. 175. Any vender of intoxicating liquor sold in Worcester county shall be liable to pay damages to any husband, wife, parent, employer or other person injured by reason of any person being intoxicated in whole or in part by liquor sold by said vender, said damages to be ascertained by a justice of the peace for said county, when the sum claimed does not exceed five dollars, without appeal, if more than five dollars then in the same manner as debts for like amounts are now recovered by law.

Be construed.
|
SEC. 176. Nothing in this act shall be construed to authorize any sale or barter or giving away of any spirituous or fermented liquor or lager beer on the Sabbath day, commonly called Sunday, or on the day of any election held in said county under the constitution and laws of this State or of the United States.

Only be necessary.
|
SEC. 177. In any prosecution under this act, it shall only be necessary to state that the traverser did sell, barter or give away spirituous liquor or fermented liquor without specifying the particular kind of liquor so sold, bartered or given away.
