license accordingly, and the said licenses shall be transferable as traders licenses now are under the general law of the State.

SEC. 170. No person, who shall obtain a license under this act shall sell or barter any intoxicating, spirituous, vinous or fermented liquors to any minor, except upon the written order of his parent, guardian or employer, or to any person intoxicated at the time;

but any hotel keeper licensed under this act may §ell intoxicating, spirituous or fermented liquor to all other persons in drinks to be drank upon the premises but not. otherwise, and any storekeeper licensed under the provisions of this act may sell the same by measure in any quantity not less than one pint, in accordance with the license issued under the provisions of this act, which liquor thus sold by measure, shall be allowed by said storekeeper to be used on his premises.

SEC. 171. Any person who shall violate any of the provisions of section one hundred and seventy of this act, shall upon indictment and conviction therefor, be fined not less than fifty nor more than one hundred dollars for the first offence, and for each offence thereafter, he shall be fined as above directed, and also be imprisoned not less than ten nor more than thirty days in the county jail, and his license maybe suppressed at the discretion of the court.

SEC. 172. No apothecary or druggist in Worcester county shall sell, barter or keep on his premises, except for the private use of himself and his family, any spirituous liquor, wine, ale, beer, schnapps or any article used and sold as a beverage in the composition or compounding of which, whisky, brandy, high wines or any spirituous or fermented liquors shall be the principal ingredient or ingredients, and any

apothecary or druggist so doing, shall, upon indictment and conviction thereof, be fined not less than one hundred dollars nor more than two hundred dollars; but nothing in this section shall be construed to prevent said druggist from keeping and using alcohol as a solvent for drugs, when such solutions are not to be used as a beverage.
