CHAPTER 62.

AN ACT to prevent the increase of gates on the public roads of Calvert county.

Not lawful.

SECTION 1. Be it enacted by the General Assembly of Maryland, That from and after the passage of this act, it shall not be lawful for any person to erect a gate upon or across any public road in Calvert county where there is not now agate already erected; and any person violating the provisions of this section shall, upon conviction thereof before a justice of the peace for Calvert county, be adjudged guilty of a misdemeanor, and be fined not more than fifty

SEC. 2. And be it enacted, That on and after the first day of April, in the year eighteen hundred and seventy-eight, it shall not be lawful for any person to keep on any public road in Calvert county any gate which is now thereon, unless said person shall have obtained from the Board of County Commis-

sioners of said county a permission, in writing, to keep said gate on said public road for twelve months next ensuing the said first day of April, and which said permission must be renewed annually, and before the first day of April in each year thereafter during which said person shall desire to keep said gate on said public road; and it shall be the duty of

said Board of County Commissioners to issue such person, and renew the same annually as hereinbefore mentioned, upon the annual payment to them of one dollar for each gate mentioned in said permission; and any person who shall, on or after the first day of April, in the year eighteen hundred and seventy-eight, keep on any public road in Calvert county any gate which is now thereon, without having first obtained a written permission and annual renewal
