                                LAWS OF MARYLAND.

    10.  AND BE IT ENACTED, That in case of the death of either
of the said petitioners before relief shall be obtained under this
act, the survivors or survivor, upon complying with the terms of
this act on his or their part, shall be entitled to the full benefit
hereby given, and be subject to all the pains and penalties thereof.

An Additional Supplement to an act *, entitled, An Act to authorise a
    Lottery to raise a sum of money for the repairs of Shrewsbury
    Church, in Kent County.

†  Ch. 76.

    WHEREAS a law passed at November session, in the year eighteen
hundred and three, authorising a lottery to raise a sum of money 
for the repairs of Shrewsbury church, in Kent county, which
directed the commissioners therein named, and in the supplement
which passed at November session, in the year eighteen hundred
and five †, before they began to dispose of, or make sale of any of,
the tickets, to give their bond tot he state of Maryland, conditioned
for the payment of ten thousand dollars, for the performance of
the trust reposed in them, and to lodge such bond in the clerk's
office of Kent county, there to be recorded, and upon an office
copy suit or suits may be instituted against the obligors therein
mentioned, or any of them, or their, or any of their legal representatives,
for any breach or noncompliance with the condition
thereof; and it has been stated, that the said commissioners took
upon themselves to act, and propose a scheme and make sale of
the tickets, and have drawn the lottery, before the bond was executed
and signed by the whole of the commissioners, and have not
lodged the bond in the clerk's office, as was directed by the original 
act and the supplement thereto, to which this is an additional
supplement; and doubts have arisen whether they could institute
suits for any monies due to them for the sale of the tickets, or
otherwise, for the benefit of the parish or institution;
Each commissioner
having taken
upon himself to
act shall be liable,
&c.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That 
each and every one of the commissioners, having taken upon themselves
to act, and proceeded to draw the said lottery, shall be liable
in all cases in the same manner as they would or might have
been by the original act, and the supplement thereto, provided they
had all signed the said bond, and lodged in the clerk's office, as
was directed to have been done; and all suit or suits that has been,
or may hereafter be, brought for against the said commissioners,
in consequence of their neglect, refusal or nonperformance, of any
of them, their, or any of their legal representatives, shall be deemed
legal and valid, as they would or might have been intended by
the original act, or the supplement thereto, to which this is an additional
supplement, any law to the contrary notwithstanding.
