CHAP. CIII.
An Act for the relief of Nancy Gaither, Sarah Gaither and Mary
Gaither, of Anne-Arundel County. Lib. TH.

WHEREAS it is represented to this general assembly,
by the petition
of Nancy Gaither, Sarah Gaither and Mary Gaither, of
Anne-Arundel county, that a law passed in the year one thousand
seven hundred and ninety-three, chapter thirty-eight, entitled, An
act to appoint commissioners to straighten and amend the roads
therein mentioned, and for other purposes, under the authority of
which law the commissioners therein named proceeded to lay out
the road from Elk-Ridge Landing by Owing's mill, and intersected
Ellicott's road at the west end of the petitioner's land, which, if
opened, will materially injure their property, inasmuch as there
will be two roads running through their lands nearly parallel: And
whereas the petitioners aforesaid have requested this general assembly
to pass a law authorising commissioners to lay out the said
road so as to intersect Ellicott's road at the mouth of their lane, at
the east end of their dwelling; and the prayer of the petitioners appearing
reasonable, therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
Thomas Worthington, of Nicholas, Vachel Burgess and Henry
Griffith, or any two of them, be and they are hereby appointed
commissioners, with full power and authority to confirm, alter or
change the aforesaid road. |

3. AND BE IT ENACTED, That the said commissioners,
or a majority
of them, shall ascertain and value what damages may be sustained
by any person or persons through whose lands the said road,
if altered or changed, may pass, taking into consideration the advantages
or disadvantages, if any, and the same, when so assessed,
shall be paid, or secured to be paid, by the said Nancy Gaither,
Sarah Gaither and Mary Gaither, to the person or persons
entitled to receive the same, before the said road, after it is laid off,
shall be opened and cleared, provided the said road shall not be
opened through the gardens, yards or orchards, of any person,
without his or her consent. |

4. AND BE IT ENACTED, That all costs and charges
which may
attend the altering, laying out and opening, the said road, shall be
at the expense of the petitioners. |

5. AND BE IT ENACTED, That the said road,
when so opened as
aforesaid, shall be kept in repair as other public roads in said county. |

6. AND BE IT ENACTED, That all proceedings
executed under
the act *, entitled, An act to appoint commissioners to straighten
and amend the roads therein mentioned, and for other purposes,
so far as relates to opening the road through the petitioner's land,
be and they are hereby declared null and void. |
