2. AND BE IT ENACTED, That it shall be the
duty of the said
commissioners, before they act as such, to lodge the bond entered
into as aforesaid in the office of the clerk of Frederick county court,
there to be recorded, and upon such bond, or any office copy thereof,
suit or suits may be instituted against the obligors therein, or
any of them, or their legal representatives, for any breach
or noncompliance with the conditions of the same. |

WHEREAS by an act, to which this is a supplement,
it is found
the sum therein authorised to be raised by lottery is insufficient
to
complete the building, and that the further sum of one thousand
dollars is prayed for; therefore, |
Preamble. |
2. BE IT ENACTED, by the General Assembly
of Maryland, That
George Nigh, Jacob Young, George Schenk, Frederick Otter,
Peter Miller, (hatter,) Anthony Hower and John Kausler, or a
majority of them, be and they are hereby authorised to propose a
scheme of a lottery for raising a sum of money, not exceeding
three thousand dollars, and to sell and dispose of the tickets thereof;
provided, that the said George Nigh, Jacob Young, George
Schenk, Frederick Otter, Peter Miller, (hatter,) Anthony Hower
and John Kausler, or a majority of them, before they proceed to
the sale of any ticket or tickets in the said lottery, shall give
bond to the state of Maryland, in the penalty of nine thousand dollars,
conditioned that they will well and truly apply the monies
arising therefrom, within six months after the drawing thereof, to
the payment of the prizes drawn therein to the adventurers to
whom they shall be due, and after deducting the necessary expenses
incurred in the management thereof, shall apply the residue,
within one year thereafter, to the finishing the steeple, and other
purposes, of Saint-John's church, in Elizabeth-town, in Washington
county, subject to the direction of the vestry thereof. |

3. AND BE IT ENACTED, That the said bond shall
be lodged in
the clerk's office of Washington county, to be there recorded, and
upon such bond, or office copy thereof, suit or suits may be instituted
