CHAP. XXVII.
An Act to authorise Commissioners to review the Roads leading
through the plantation of Henry Hershberger, of Frederick
County.

Preamble. |
WHEREAS it is represented to this general assembly,
by the petition
of Henry Hershberger, of Frederick county, that he is possessed
of a tract of land lying in said county, at which place a
number of roads centre, to the great injury and inconvenience of
the said petitioner; and the said petitioner having prayed that an
act may pass, authorising commissioners to shut up a certain part
of the road in the petition aforesaid mentioned, and the inconvenience
being trifling to the public, in comparison to that which the
said Hershberger labours under, and especially as there still will
remain a road through a part of his land for public use; and the
prayer of the petitioner appearing reasonable, therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
Patrick McGill, William Luckett, James Samuel Hook, James
Simmons and Daniel Lakin, be and they are hereby authorised and
appointed commissioners, with full power and authority to enter on
the lands of the said Henry Hershberger, and if, upon viewing the
premises, and the roads that run through the same, they shall be
of opinion that no material injury would result to the public by
shutting up the said road, then the said commissioners, or a majority
of them, shall return a certificate, under their hands and
seals, to the clerk of the county court, certifying their opinion and
determination respecting the premises, and the clerk of the said
court shall record the same, then, and not before, the said Henry
Hershberger shall have full power and authority to shut up the said
road. |

3. AND BE IT ENACTED, That the expenses arising
in the execution
of this act shall be paid by the said Henry Hershberger. |

WHEREAS it is represented to this general assembly,

of sundry inhabitants of Saint-Mary's county, that they experience
great inconvenience for the want of a fourth district in the
said county, and praying an alteration in the first and third districts,
so as to establish and admit of a fourth between them; and
the prayer of the petitioners appearing reasonable, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
all that part of the constitution and form of government, made
such by the acts of seventeen hundred and ninety-eight * and seventeen
hundred and ninety-nine, † which directs that Saint-Mary's
county shall be divided and laid off into three separate districts,
be and the same is hereby repealed. |
