in Caroline county, that they experience great inconvenience
from the going at large of swine, goats and geese, in said village,
and from the multiplicity of useless dogs, and are liable to
loss by chimnies taking fire; therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
it shall not be lawful for any person or persons residing in the village
or county aforesaid, to suffer to run at large, within the limits
of the village aforesaid, or within half a mile thereof, to be computed
from the boundary stone of Elizabeth Downe's lot, any swine,
goats or geese; and if any swine, goats or geese, shall be found
running at large within the limits of the said village, it shall be
lawful for a bailiff, to be appointed as herein after directed, or any
person or persons belonging to the said village, in case of his absence,
and he or they are hereby authorised and empowered, to
seize all and every such swine, goats or geese, to impound the
same; and the said bailiff shall immediately, by public advertisements,
give notice of the impounding of such swine, goats or geese,
and if the owner or owners shall not, within three days thereafter,
pay the said bailiff, for every day of the impounding of any swine
or goat, the sum of fifty cents, and for every goose six cents, it
shall and may be lawful for such bailiff to sell the same at public
sale, and pay the balance to such owner or owners, after deducting
one dollar and fifty cents for every swine or goat, and twenty
cents for every goose, impounded as aforesaid. |

3. AND BE IT ENACTED, That if any person residing
in said
village shall permit or suffer his or her chimney to catch fire, so as
to blaze out of the top, such person or persons shall forfeit and pay
the sum of three dollars for every such neglect. |

4. AND BE IT ENACTED, That if any person residing
in the said
village shall keep or suffer any dog or bitch to remain about his or
her house for the space of one week, such person shall pay the sum
of fifty cents, on or before the first day of January annually. |

5. AND BE IT ENACTED, That the fine laid on
any person whose
chimney takes fire as aforesaid, and the tax on dogs and bitches,
shall be recovered in the name of the trustees of Hillsborough
school, before a justice of the peace, as in the case of small debts,
and the money arising therefrom to be applied by the said trustees
to the payment of the tuition of poor children at the said school.

6. AND BE IT ENACTED, That the trustees of
Hillsborough
school, or a majority of them, shall, at their first meeting after the
first day of March in every year hereafter, appoint a fit person residing
in the village aforesaid to be bailiff, who shall have power,
under their direction, or the direction of any justice of the peace
who may reside therein, to execute this law, and the duties of a
constable, other than the serving warrants for small debts.
