    Upon appeals from chancery court or county
courts as courts of equity, where proper parties have
not been made, court of appeals may reverse the decree
or award a new trial, specifying in the order for a
writ of procedendo, the parties to be made, &c.

    Provision made for decreeing a partition of lands
held by infants, idiots, &c. jointly with other persons,
  Extended to infants residing out of the state
on answer being taken by commissioners to be appointed
by the chancellor,
  Extended to cases where all the persons reside
out of the state,
    Partition to be made of real estates on those who
may have received a part bringing it into hotchpot,
  To be made by commissioners where the real
estate will admit of division,

    When it is necessary under a will to retain the personal
estate or a part thereof (after the payment of
debts) as where money or some other thing is directed
to be paid at a distant period, or upon a contingency,
the court of chancery or the orphans court shall have
power to decree or give directions relative thereto,

    Any child or children born after the death of an
intestate shall have the same right of inheritance
of real estate as if born before the death,

    No part of the real estate of infants to be diminished
without the consent and approbation of the
chancellor,
    The principal of an infant's estate may be applied
to the maintenance and education of such infant,
with the approbation of the chancellor or county
courts,
