COUNTY COURTS

    Directions how to proceed in case the widow does
not consent to a sale,
      How vacancies are to be supplied on the death
of trustee,
    Where infants are seized of a reversion dependent
upon an estate for life, &c. tenant for life assenting to
a sale, county courts or chancellor to adjudge the annual
interest, &c. to be paid to such tenant for life,
    In all cases where nonresidents are parties, courts
to direct notice to be given by advertisement in the
public newspapers for such party to appear, &c. on
such notice being given the court to hear and determine
in the same manner as if such party had appeared,
    Upon petitions of guardian or prochein ami for the
sale of the real estate of infants, the courts to issue
commission to ascertain the real value of the land, &c.
    Commissioners to report, &c.
      To take an oath impartially to ascertain the
value of such lands, &c.
    Appeals from orders of county courts confined to
decretal orders, &c.
    Provisions of the 5th sec of the act of 1785, ch.
72, and its supplements, extended to defendants of
full age,
      Of the fifteenth section of same act, extended
to clerk employed on the commission,
    Not necessary to make any demand of a compliance
with the decree to entitle the party, &c. to process,
    In cases where power is given to take bills pro confesso,
or to issue commission, &c. decisions may be
made on testimony taken before the parties instead of
issuing commission,
    Provisions of the act of 1797, ch. 43, extended to
county courts as courts of equity,
    County courts may decree a sale of equitable titles
to real estates,
      May, as courts of equity, decree a sale of the
real estate to save the personal, &c.
      May, where sales have been made by executors
under a supposed authority of a will, confirm
such sales,
    In case of lands descending to minors residing out
of the state, on bill filed courts may issue commission
to three persons to appoint guardian to defend the
suit,
    Same proceedings to be had as if infants had been
summoned, &c.
    Courts may decree a sale of such lands if for the benefit
of such infants,
    Upon appeals from chancery, or county courts as
courts of equity, if it appear that proper parties have
not been made, court of appeals may reverse the decree
or award a new trial, &c.
    In cases of judgments, decrees, &c. unrecorded in
the several county courts, clerks to grant an official
copy in like manner as if such judgments, &c. had
been duly recorded, &c.
    Judges of the county courts, where such papers,
judgments, &c. remain unrecorded, to examine the
dockets, and cause such unrecorded papers, &c. to be
recorded, &c.
    Books to be brought before the court to determine
whether the records are made up agreeably to law,
&c.
    Upon failure of the officer to perform the duties,
his bond to be sued, &c.
    The clerks or registers of courts of justice to make
up and complete their records, &c.
