LAWS OF MARYLAND.
certificate of the courses of said road, and their estimate of the damages
as aforesaid, to the clerk of Harford county, to be recorded
among the land records of said county, and when the same shall
have been so returned, the said road shall for ever thereafter be
deemed a public highway, and shall be kept in repair as other public
roads in Harford county; Provided always, that the said commissioners
shall not lay out the said road through the buildings,
garden or orchards, of any person, without his or her consent. |
Overseer to be appointed. |
4. AND BE IT ENACTED, That the levy court
of Harford county
be and they are hereby empowered and directed, at their next
meeting after the plot directed by this act shall have been returned,
or at any subsequent court, to appoint an overseer to open and
clear said road, agreeably to said plot, in the same manner as
other roads are by law directed to be opened and cleared; and
the said overseer shall have the same allowance as other overseers. |
Allowance to commissioners. |
5. AND BE IT ENACTED, That the commissioners
appointed by
this act shall have an allowance of two dollars for every day they
shall severally attend in discharge of the duties hereby imposed. |
Levy for opening
road. |
6. AND BE IT FURTHER ENACTED, That the levy
court of the
said county, at the time of laying the next levy for the said county,
or any time within six months after the said road shall be opened
and cleared as aforesaid, shall levy, on the assessable property
of the said county, such sum or sums of money as they may deem
necessary for the purpose of surveying, opening, clearing and repairing,
the said road; and at their said levy court next after the
return of said plot, they are hereby farther authorised and empowered
to levy the damages sustained by the owners of the land
through which the said road shall pass, and also for the compensation
to the commissioners as is herein before directed to be paid. |

An Act authorising certain Lotteries within the City of Baltimore.

WHEREAS it is represented to this general assembly,
by the trustees
of the Impartial Free School, and by the committee of the second
presbyterian church, in the city of Baltimore, that their
funds are inadequate to carry into effect the laudable purposes contemplated
by the petitioners, and praying that a law may pass authorising
them to raise by lottery certain sums of money: And
whereas by an act, * entitled, An act to erect Baltimore-town, in
Baltimore county, into a city, and to incorporate the inhabitants
thereof, the drawing of lotteries within the said city is confined
to
special purposes; therefore, |

2. BE IT ENACTED, by the General Assembly
of Maryland, That
from and after the passage of this act, it shall and may be lawful
for the mayor and city council of Baltimore to authorise the trustees
of the Impartial Free School, and the committee of the second
presbyterian church, in the city of Baltimore, respectively, to institute
a scheme or schemes of a lottery or lotteries within the said
city, and to dispose of tickets therein, for the purposes contemplated
by this act, under such limitations as the mayor and city council
shall by ordinance direct. |
