The bounds of lands, how to be ascertained,
Five persons in each county to be commissionated,
and empowered to hear and determine all
differences and controversies which may happen
in their respective counties, between persons
thereon, of, for, touching or concerning the bounds
and metes of land,
Commissioners oath,
Commissioners to appoint certain days,
and
make publication thereof, whereon to meet at the
court house of the county, at which said place,
upon complaint made by any person touching any
dispute concerning the bounds or limits of any
tract of land, to appoint a day on which to go upon
the land in dispute, to view, &c.
Upon petition or complaint in writing
by any
person concerned in disputable bounds, the commissioners
to grant summons to the parties, &c.
to witnesses, &c. to appear, &c. and upon appearance
or default, to proceed to the determination
of the controversy, &c.
Where surveyors wilfully refuse or
neglect to
appear, &c. to forfeit five hundred pounds of tobacco
for every offence, to be recovered in any
court of record by action of debt, bill, &c.
Witnesses summoned, neglect to appear,
or appearing
refuse to give evidence, attachments to issue,
&c.
Commissioners to cause the lands to
be surveyed to
discover the true bounds, &c. record whereof to be
made and lodged with the clerk of the county, &c.
complainant or defendant, as the case may be, to be
put into peaceable possession, &c.
Compensation to commissioners,
Fees to surveyors ascertained, &c.
Commissioners to order and settle the
fees or rewards
for their clerks, other officers or assistants,
&c.
Sheriffs, coroners and constables,
to execute in
all things any precept directed to them from commissioners,
&c.
Any person who shall molest any commissioners,
surveyors, &c. in the performance of their
duty, to forfeit and pay 1000lbs. of tobacco, &c.
In any suit or action against any
person for any
thing done in pursuance of this act, such person
may plead the general issue, and give the special
matter in evidence, and upon discontinuance of
the suit, judgment to pass, &c. |
