PENITENTIARY

            INDEX TO THE LAWS.
 

parts of the lots therein mentioned with the
levy court of Baltimore county,
    Offences mentioned for which the punishment may
be by death or confinement in the penitentiary,
 
 
 

    Punishment for burning the penitentiary,
    Punishment of slaves in certain cases in the discretion
of the court, instead of being sent to the penitentiary,
    Every person convicted of any felony before deemed
clergyable, to be sentenced to confinement in the penitentiary
for the time therein limited,
    The court to decide and declare the time (within
their respective periods prescribed,) of confinement
according to this act,
    The penitentiary house, then in part erected in Baltimore
county, in the vicinity of the city, under a resolution
passed in 1804, appropriated, when put in order,
for the reception of criminals, &c.
    The cells of the penitentiary to be appropriated to
the purpose of confining males and females convicted
of offences punishable with imprisonment and labour,
but the males and females to be kept separate and
apart from each other,
    All prisoners to be subject to the visitation and superintendance
of the inspectors,
    Persons convicted to be removed by the sheriff at the
expense of the county, to the penitentiary, and to be
there kept, &c.
    Fine on sheriffs for wilful neglect,
    The criminals to be kept in solitary cells, on low and
coarse diet, for such time as the court in their sentence
shall direct, not to be more than a half nor less than a
twentieth part of the time,
    The inspectors to direct the infliction of the said solitary
confinement, at intervals, &c.
    Directions as to clothing, diet, labour, instruction
therefor, and the duties of the inspectors or the keeper,
    Such offenders to be employed in work every day, except
Sundays and Christmas day; the hours of working
prescribed, after which the working tools are to be
removed,
    In order to encourage industry, accounts to be kept
of the value of the work, and the excess (after paying
expenses,) to be applied to the reparation adjudged,
and then to the offenders at their discharge,
    Offenders labouring under any acute or dangerous
distemper not to be discharged (unless at their own request,)
until they can be safely discharged,
    Offenders escaping, to suffer, on conviction, additional
confinement, &c.
    Keepers, &c. aiding in such escape, to be confined
in the penitentiary nor more than 15 years,
    Means to be used for preventing contagious diseases
in the introduction of prisoners,
    Directions for having the walls in the apartments
white washed, and the floors washed by the prisoners,
    The prisoners may be permitted to take the air and
to work in the yard within view,
    One or more apartments to be fitted up as an infirmary,
the sick to be removed there,
    The governor and council to appoint a suitable person
to be keeper of the penitentiary, who shall be removed
whenever occasion may require, and another
