MILITIA

            INDEX TO THE LAWS.
 

    Penalty on militia-men leaving their companies, unless
by consent of the commanding officer, or on removal
to another district,
—In such case a certificate to be given by the officer,
on application, stating his discharge, and the
time of actual service, under the penalty therein mentioned,
    No person serving as a substitute for another shall
thereby be excused from standing a draught himself,
    No officer, non-commissioned officer or private, in
his attendance at, going to, or returning from muster,
shall be subject to arrest for any civil matter,
    On suit for any thing done in the execution of this
act, the general issue may be pleaded, and the act and
the special matter given in evidence,
    No person to be a commissioned officer unless he
shall be a citizen of the United States and of this state,
    Each officer to take the oath therein prescribed,
which shall be endorsed on the back of the commission,
    By-standers interrupting, molesting, or insulting any
officer or soldier while on duty, at muster, or in a court
martial, may be confined for the day, and fined by such
court martial,
    Brigade inspectors required to make returns of arms,
&c. yearly, to the adjutant general, under the penalty
therein mentioned,
—Their duty to attend the brigades general, to receive
and execute orders, &c.
—Penalty for refusal or neglect,
    The adjutant of each regiment and extra battalion to
attend the meetings thereof, and execute the orders of
the commanding officer,
—Penalty for refusal or neglect,
    Manner of compelling the delivery of state arms,
(not held by a person as a member of a volunteer company,)
and penalty on refusal to deliver them,
    On the death, removal, &c. of a subaltern officer,
the commanding officers may appoint a fit person as a
brevet officer, and notify the governor,
—Such brevet officer, till superseded, to have all the
powers incident, as if commissioned,
—But the removal of the officer to a different part
of a town, &c. shall not be considered as a resignation,
    The militia of Allegany county to be exempt from
regimental and battalion meetings—the company at
Selby's Port, and also that at the Green Glades, to be
exempt from battalion meetings.  Regulations as to the
company meetings,
    The militia on Kent Island not compelled to meet in
battalion or regiment,
—Regulations concerning the company meetings,
    The militia when called into actual service to be subject
to the rules and regulations of the articles of war,
—Entitled to the same pay and rations as troops in
the service of the United States,
    Certain companies in Somerset and Washington
counties exempted from meeting in regiment or battalion,
and the company meetings increased,
    The militia on Hooper's Straits, in Somerset and
Dorchester counties, and Assateague Island in Worcester
county, exempted from meeting on the main,
—How to be called together for exercising,
    Commandants of regiments and extra battalions
may each organize a band of musicians,
—To be under their command, and liable to fines,
&c. as non commissioned officers and privates,
    Captains, &c. may enrol from two to four persons
to serve as musicians, instead of privates,
