            INDEX TO THE LAWS.
 

by ballot by the clerk, under the direction of the court,
—their names to be written on two lists, one to be
delivered to the party indicted, or his counsel, and the
other to the prosecutor,
—Each party authorised to strike out four, and the
remaining twelve to be sworn,
—Not to take away the right to challenge the array
or polls, or any juror for cause,
—By consent the drawing of  such pannel may be
dispensed with, &c.
    By-standers to be summoned, where without them
twenty would not remain to be drawn,
    In suits against executors, &c. the jury to ascertain
the amount of assets if put in issue,
    Allowance to jurors, except in the counties of Baltimore,
Allegany, Harford, Calvert, Somerset and Frederick,

    Acts relating to jurors in Baltimore county,

    Quakers, Nicolites, Menonists, Tunkers, and
others holding it unlawful to take an oath on any
occasion, allowed to make their solemn affirmation
as a qualification as jurors, to be of the same avail
as an oath to all intents and purposes,
—The court to be first satisfied by testimony that
such person is one of those who profess to be conscientiously
scrupulous of taking an oath,
    Allowance to jurors in Somerset county,
    The jury, if they find a person guilty of murder,
to ascertain by their verdict the degree,
    Every embracer procuring a juror to take gain or
profit for rendering his verdict, and every juror taking
such gain, on conviction to be confined in the penitentiary,
not less than 1 nor more than 6 years, and
the juror to be disqualified to serve as such for ever
thereafter,

    Provisions concerning challenges and the empannelling
of jurors in criminal cases,

    Any alien, denizen or foreigner, when indicted, to
be tried by a jury of the country, in the same manner
as a citizen, and no challenge allowed to the array of
polls for want of foreigners on the pannel or jury returned,
    A juror to be withdrawn if amendment is made after
the jury is sworn,
    So much of the laws as requires a property qualification
in land or money in persons summoned as jurors,
repealed,
    Allowance for mileage to jurors in Frederick and Allegany
counties,
    Allowance to jurors on a coroner's inquest,
    Allowance to mileage to jurors in Washington county,
    The allowance to jurors in Baltimore increased,
—Same, in Saint Mary's county,
—Same, in Harford county,
—Directions to the sheriff to note on the list the
distance of each juror's residence, &c.

    May issue attachment against witnesses not attending,
fine them, and issue execution,
—Such fine to be paid by the constables to the justices,
and by them returned annually and paid to the
county clerks, &c.
