CRIMES AND PUNISHMENTS

            INDEX TO THE LAWS.
 

knowledge and abuse of any female under the age of
ten years, to be deemed felony—death by hanging, or
confinement &c. not less than 1 nor more than 21
years.  8th.  Sodomy—confinement &c. not less than 1
nor more than 10 years.  9th.  An assault with intent to
rob, murder, or commit a rape—confinement &c. not
less than 2 nor more than 10 years.  10th.  Kidnapping,
and forcibly or fraudulently carrying or causing to be
carried out of the state, any free person, or person entitled
to freedom at or after a certain age, &c. or knowingly
arresting such person with such intent, or aiding,
&c.—confinement &c. not less than 2 nor more
than 10 years,
    The offences hereinafter mentioned, affecting the habitations,
houses or vessels of individuals, to be punished
in manner following:
    1st.  Arson, or as being accessary—death by hanging,
or confinement &c. not less than 5 nor more than 20
years.  2d.  Wilfully burning any mill, distillery, tobacco
house, &c. or other out house, not being parcel
of a dwelling house, being empty, or having therein
any tobacco, &c. or burning any stack of hay, &c.
and aiding therein—death by hanging, confinement
&c. not less than 3 nor more than 12 years.  3d. Wilfully
burning any ship or vessel of seventeen feet keel
or upwards—confinement, not less 2 nor more than 12
years.  4th.  Burglary, or as accessary before the fact
—restoration or payment of the value, and confinement
&c. not less than 3 nor more than 10 years.  5th.
Breaking a dwelling house in the day time, or a store
house, &c. in the day or night, with intent to commit
murder or felony therein, or aiding, &c.—confinement
&c. not less than 2 nor more than 10 years.  6th.  Breaking
into a shop, &c. though not contiguous to or used
with the mansion house, and stealing money, goods,
&c. to the value of one dollar or upwards, or as being
accessary thereto—restoration, or payment of the value,
and confinement, &c. not less than 2 nor more
than 12 years,
    The offences hereinafter mentioned, affecting private
property, to be punished in manner following:
    1st.  Simple larceny, to the value of five dollars and
upwards, or as accessary before the fact—restoration or
payment of the value, and confinement &c. not less
than 1 nor more than 15 years.  2d.  Robbery, or as
accessary before the fact—restoration or payment of
the value, and confinement &c. not less than 3 nor
more than 10 years.  3d.  Stealing any horse, &c. or
as accessary before the fact—restoration or payment of
the value, and confinement &c. not less than 2 nor
more than 14 years.  4th.  Maliciously stabbing or killing
any horse, &c. not the property of the person, or
trespassing on his enclosures—confinement &c. not
less than 1 nor more than 4 years.  5th. Stealing any
ship &c. of seventeen feet keel, or upwards, from within
the body of any county, or on Chesapeake bay,
within the jurisdiction of the state, or feloniously taking
and carrying away any negro or other slave, or
aiding &c.—restoration of the vessel or slave, or payment
of the value, and confinement not more than 12 
years.  6th.  Stealing personal goods under the value
of five dollars, or breaking into a shop, &c. not contiguous
to or used with any mansion house, and stealing
money, &c. under the value of one dollar—restoration
or payment of the value, and confinement &c. not less
than 3 months nor more than 1 year.  The same course
of trial to be had as in other simple larcenies, and the
person on conviction deemed guilty of petty larceny.
7th.  Robbery or larceny of a bond, &c. for payment of
