the commissioners,

No road to pass through the buildings,
yards, gardens,
or orchards, of any persons, without consent of
the owner,
If no objection within the four first
days of the next
term, the court to pass judgment, &c.

damages, subject
to the order of the court,
The court to determine whether they shall be
paid by the petitioners or the county, or in proportion
by both,
