appointed upon said road under the original act, shall open the
same agreeably to such plot to be returned by the commissioners
of review as aforesaid, and shall keep the same in repair; Provided,
that the assent, in writing, of every person over whose land the
said road may pass, in case the same shall be altered, shall be first
had and obtained, and returned to the levy court of said county;
And provided also, that nothing herein contained shall authorise
said commissioners of review to alter the running of the said road
so as to pass over the lands of any infant, or person non compos
mentis.

CHAP. 30.

Provisos.

    3.  AND BE IT ENACTED, That the commissioners of review appointed 
under this act shall have the same allowance for every day
they shall severally attend to discharge the duties hereby imposed,
as the commissioners were entitled to under the said original act.

                                        CHAP. XXXI.
An Act to authorise the Trustees and other Members of the German
    Catholic Church in the Precincts of Baltimore to raise a sum of money
    by Lottery for finishing said Church.

Passed Jan. 8, 1803.
    WHEREAS it is represented to this general assembly, by the petition
of the trustees and other members of the religious society of
people denominated St. John's German Catholic Church, that they,
having heretofore purchased a lot of ground in the precincts of the
city of Baltimore, and erected thereon a house for public worship,
and the subscriptions heretofore obtained for finishing said building
having proved inadequate, that large debts have been already incurred
by the congregation, and that from the moderate circumstances
of the members thereof they are unable to finish said building,
without the aid of funds to be obtained otherwise, and praying
for an act to pass in this particular case, authorising a lottery
for providing funds for the purpose aforesaid; therefore,
Preamble.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That 
Michael Riddlemoser, John Gross, John Scheuler, Peter Walter,
Sebastian Hickley, Jacob Shorb, Francis Gillmyer and John Ehzman,
or any five of them, be and they are hereby authorised to
propose a scheme of a lottery, and to sell and dispose of tickets
therein, for raising such sum of money as they, or any five of
them, shall consider sufficient to discharge the debts incurred, and
to complete and finish said building, not exceeding four thousand
dollars.

    3.  AND BE IT ENACTED, That before the said Michael Riddlemoser,
John Gross, John Scheuler, Peter Walter, Sebastian Hickley,
Jacob Shorb, Francis Gillmyer and John Ehzman, proceed to
the sale of any ticket or tickets in the said lottery, they shall give
and execute a bond to the state of Maryland, in the penalty of
eight thousand dollars, conditioned, that they will well and truly
conduct the drawing of the said lottery, and apply the money arising
therefrom, within six months after the drawing thereof, to the
payment of the prizes drawn therein to the adventurers to whom
they shall be due, and the necessary expenses incurred in the
management thereof, and the residue to the finishing of said building.
And give bond.
    4.  AND BE IT ENACTED, That the said bond shall be lodged in
the office of the clerk of Baltimore county, to be there recorded,
