CHARLES RIDGELY, OF HAMPTON, ESQ. GOVERNOR.

Institution Lottery*, or Medical College Lottery†, the prizes
drawn therein to be nevertheless subject to the five per centum by
this act imposed upon all prizes (a); And provided further, that before
a drawing of any lottery shall be had under the foregoing proviso,
the managers shall give bond, with two or more sufficient securities
to be approved by the treasurer of the western shore, conditioned
for the payment of the said five per centum into the treasury,
at the expiration of sixty days after the drawing shall be
completed; and the managers of any lottery offending against the
provisions aforesaid, shall forfeit severally the sum of five thousand
dollars, to be recovered by indictment in the county court of
the county where the offence shall be committed, or in the city
court of Baltimore, as the case may be, for the use of the state.

    2.  AND BE IT ENACTED, That the managers of all lotteries
which may hereafter be drawn in this state, be and they are hereby
authorised and required, to deduct from all prizes in said lotteries
five per centum, in addition to the deduction provided for by
the scheme of said lottery, and within sixty days after the drawing
of any such lottery shall be finished, shall pay over the said five
per centum to the treasurer of the western shore of Maryland, for
the use of the state, and in case they do not so pay over the said
five per centum, the bonds of said managers shall be put in suit
in the county where they may reside.

    By 1818, ch. 179, the managers to pay to the treasurer five per cent upon the
gross amount of prizes, and on payment thereof, and not before, the commissioners
to permit the drawing the lottery.

    3.  AND BE IT ENACTED, That the governor and council be and
they are hereby authorised and empowered, to appoint and commission
three discreet and good men, to be styled Commissioners of
Lotteries, removable at the will of the governor and council, and
each commissioner shall be entitled to receive an annual salary of
twelve hundred dollars, to be paid out of the aforesaid five per centum
deduction from prizes, and from no other monies, which said
salary the treasurer of the western shore is authorised to pay semi-annually
out of said funds only.

    4.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, be and they are hereby authorised and empowered,
to appoint some fit and proper person to act as their clerk, removable
at the pleasure of a majority of said commissioners, who shall
be entitled to an annual salary of one thousand dollars, payable
from the same fund, and in the same manner as the salary of the
commissioners.

    5.  AND BE IT ENACTED, That the managers of all lotteries
hereafter to be drawn, except as before excepted, shall submit the
schemes thereof to said commissioners, who if they find the same
not contrary to the law authorising the same, and the provisions of
this act, shall approve it, and upon such approval the said managers
shall, as soon thereafter as they may choose and be prepared
so to do, present the tickets in said lottery to said commissioners,
whose duty it shall be, without delay, to examine the numbering
and signing said tickets, and upon finding the same correct, some
one or more of said commissioners shall sign his or their name on
Schemes to be submitted
to commissioners.
