LAWS OF MARYLAND.
of the said stock shall have been subscribed, agreeably to the provisions
of the said act; and that as soon as the said road shall be
perfected from the line of the District of Columbia to Rockville in
Montgomery county, the sid president, managers and company,
are hereby authorised to erect and fix such and so many gates or
turnpike upon and across the said road, as will be necessary and
sufficient to collect the tolls and duties granted to the said company,
in the same manner, and to all intents and purposes as if they had
perfected the said road for a distance of ten miles, any thing in the
aforesaid act to the contrary thereof notwithstanding; Provided
however, that the said road shall be first examined, approved and
licensed, as directed and required in the thirteenth section of the
aforesaid act. |

CHAP. CXVIII.
A Supplement to the act, entitled, An act to lay out and make public
the Roads therein mentioned in Harford County, and for
other purposes,

Commissioners appointed
to lay out
a road. |
1. BE IT ENACTED, by the General Assembly
of Maryland, That
James McComas of James, John McGaw, and Isaac Perryman, be
and they are hereby appointed commissioners, and they, or a majority
of them, are hereby authorised and required to lay out and
survey a road, not exceeding thirty feet wide, to begin at the south
end of Webster's long lane, thence on the nearest and best direction
the nature of the ground will admit of, and with the least possible
injury to individuals through whose land the same may pass,
by William Patterson's, to intersect the Baltimore and Philadelphia
road at Duncan's shop. |

for a public
landing.

2. AND BE IT ENACTED, That the said commissioners,
or a majority
of them, are hereby authorised and empowered, in their discretion,
to lay out, mark and bound, a lot of ground at or near to
George Presbury's landing, not less than forty perches long and
four perches wide, along the edge of the water, at low-water mark,
and condemn the same as a public landing for the use of the citizens
of Harford county; and the said commissioners, or a majority
of them, are hereby authorised and empowered to lay out and open
a road, to begin at some convenient point on the road authorised to
be laid out by the first section of this law, near the upper end of
William Patterson's field next to Doctor Thomas Archer's, thence
on the best direction the nature of the ground will admit to intersect
the post road, thence in the nearest and best direction, and
with the least possible individual injury, to the aforesaid landing
place; Provided, that the said roads shall not be made to pass
through the buildings, yards, gardens or orchards, of any person
or persons, without the consent of the owner or owners thereof
first had and obtained. |
Plots to be made. |
3. AND BE IT ENACTED, That it shall be the
duty of the said
commissioners, or a majority of them, to cause a plot and certificate
of said roads and landing place to be made out and returned
to the levy court of Harford county, whereupon the said levy court
be and they are hereby authorised and directed, to levy upon the
assessable property of the said county such sum of money as they
may deem necessary for opening and clearing said roads, and shall |
