may become subscribers and stockholders therein, and transfers
of stock in said companies may be made by corporation or
bodies politic, of their stock in said companies, in such manner as
the said companies shall and may from time to time by their laws
appoint and direct.

CHAP. 97.

    34.  AND BE IT ENACTED, That whenever the new roads shall
depart from the beds of the old roads respectively, it shall and may
be lawful for the president and managers of the said companies
respectively, with the consent of the owner or owners of the land
through which the old roads may pass, to shut up the same.
Old roads may be
shut up.
    35.  AND BE IT ENACTED, That the said presidents and managers
shall ascertain and value what damages may be sustained by
any person or persons through whose land the said road shall pass,
and the same, when so assessed, shall be paid, or secured to be
paid, before the said president and managers shall proceed to open
the said road; Provided always, that if any person or persons
through whose land the said road shall pass, or his, her, or their
guardian or trustee, shall conceive themselves aggrieved by such
valuation and assessment of damages by the said presidents and
managers, it shall and may be lawful for the said presidents and
managers, or any two of them respectively, to issue their warrant
to the sheriff of the county aforesaid, commanding him to summon
twelve freeholders in the county aforesaid, and not interested in
the premises, and qualified to serve as jurors in the county court,
to appear on a day by them to be appointed on the premises; and
the said presidents and managers, or any one of them respectively,
are hereby authorised to administer an oath, or affirmation, as the
case may be, to every person so summoned, that he will, without
favour, affection, partiality or prejudice, assess the damages sustained
by the person or persons at whose request such inquisition
shall be taken, by reason of the opening the aforesaid road through
his, her, or their land; and the persons so summoned and so qualified,
shall thereupon proceed to assess and value the damages
accordingly, of which the said presidents and managers, or some
one of them respectively, shall have given at least ten days notice,
and such inquisition shall be final and conclusive between the parties;
and in assessing the damages the jury shall take into consideration
the conveniencies and inconveniencies, the advantages or
disadvantages, if any, arising to the proprietors of the land over
which the said road or roads may pass.

Proviso.
    36.  AND BE IT ENACTED, That so much of the third section of
the law passed at November session, eighteen hundred and five*,
entitled, An act to incorporate a company to make a turnpike road
from the line of the District of Columbia, where it crosses the post
road leading from George-Town to Frederick-Town, through Montgomery
and Frederick counties, to Frederick-Town, as require
that two thousand five hundred shares or more of the said stock in
the said company shall be subscribed, before the said corporation
can be organized, and any other parts of any section of the said
law which may be inconsistent with, or repugnant to, the provisions
of this section, are hereby repealed; and the commissioners named
in the supplement to the said act passed at November session, eighteen
hundred and twelve†, are hereby authorised and permitted to
organize the said company so soon as fifteen hundred shares or more
