feet on the north-west side thereof, from High-street eastwardly,
to the city line; and said street, when so widened, is hereby declared
a public street and highway, of the width of seventy-nine
and an half feet from High-street to the east line of Union-street,
and shall be subject to the like rules and regulations as other public
streets of the city, the footways of which shall be of such width
as the city commissioners shall fix and determine. |

2. AND BE IT ENACTED, That the mayor of the
city of Baltimore
shall, on or before the first day of April next, appoint five
disinterested freeholders, assessors, who having first taken an oath
before some justice of the peace of the county aforesaid, to decide,
without favour, affection or partiality, who shall proceed forthwith
to value and assess the damages which may be sustained by the
respective owners of the lots of ground upon which the said street
shall be so widened, and also to designate the property to be benefitted
thereby, taking into consideration all advantages and disadvantages,
which damages they shall apportion amongst the owners
of the property benefitted, and make return of their proceedings
on or before the first day of May next, including all necessary and
reasonable costs and expenses incurred, or to be incurred, in virtue
of this law, under their hands and seals, to the register of the city
of Baltimore, who shall file and keep up the same in his office. |

3. AND BE IT ENACTED, That the damages, when
so valued
and assessed, from the time of the return of the proceedings as
aforesaid, shall be a lien upon the property so ascertained and determined
to be benefitted, until their respective proportions of said
damages shall have been paid. |

4. AND BE IT ENACTED, That the assessors aforesaid
shall be
entitled to receive two dollars per day as a compensation for their
services in performing the duties required of them by this act. |

5. AND BE IT ENACTED, That the city collector
of Baltimore
be, and he is hereby authorised, to collect the said damages, costs
and expenses, in the same manner that the city taxes of said city
are authorised to be collected, and in case of neglect or refusal to
pay, by public sale of the property ascertained and determined to
be benefitted as aforesaid, or so much thereof as shall be necessary,
of the person or persons so neglecting or refusing, he giving
at least thirty days notice of the time and place of such sale, previous
thereto, in two or more of the newspapers published in said
city, and when collected, to pay over the same to the person or
persons respectively entitled to receive the same in pursuance of
the provisions of this act; and as a compensation for his services,
the said collector shall be entitled to a commission of six per
centum on the whole amount to be by him collected; Provided
however,
that the improvements on lot number sixty-five, to the extent
of one hundred and ten feet eastwardly from High street, shall not
be removed during the life of Sarah Goldsmith, widow, unless her
assent thereto, in writing, be first obtained, and within six months
after assent is obtained, or her decease, the commissioners aforesaid
shall remove all obstructions on that part of said street; and
no removal of any improvement shall take place under this act,
until the commissioners aforesaid are fully satisfied the valuation
to be made as is herein before directed shall have been tendered or
paid. |
