LAWS OF MARYLAND.
commissioners to lay out, survey, mark and bound, a public
road, not exceeding thirty feet in width, beginning at the main
road leading from George-Town to Dixon's tavern, on the divisional
between Vincent Benton and Senah Busick, and running in
such direction to the road leading from J. B. to the head of Chester,
at the intersection of the road leading from McAllister's Ferry
to said road, as they, or a majority of them, shall deem most advisable
for the public convenience, and return a plot thereof, with
a certificate of courses and distances of the same, to the clerk of
Queen-Anne's county, to be by him recorded. |
Damages to be ascertained. |
2. AND BE IT ENACTED, That the commissioners,
or a majority
of them, be and they are hereby authorised and directed, to ascertain
and value what damage may be sustained by any person or
persons through whose lands the said road may pass, by opening
the same, taking into consideration all the advantages and disadvantages
in consequence thereof, and the damages so ascertained
shall be levied and assessed as other county charges are, and shall
be paid over to the person or persons entitled to receive the same. |
Costs to be levied. |
3. AND BE IT ENACTED, That the said commissioners,
or a majority
of them, when the said road shall be laid out and marked,
shall cause the same to be opened, cleared, and made passable, and
shall return an accurate account of the costs and expenses of laying
out, clearing, and opening the said road, to the levy court of said
county, and the justices of the said levy court are hereby authorised
and directed to levy the same on the assessable property of said county,
and when so levied shall be collected and paid over to the person
or persons entitled to receive the same, as other county charges
are; and the justices of the levy court are hereby authorised to allow
such compensation to the commissioners, in the execution of
this act, as they shall deem reasonable, not exceeding two dollars
per day each. |
Road to be public. |
4. AND BE IT ENACTED, That the said road when
opened,
cleared and made passable, shall for ever thereafter be deemed a
public highway, and shall be kept in repair as other public roads
are in said county. |
Vacancies, how to
be supplied. |
5. AND BE IT ENACTED, That the said commissioners,
or a majority
of them, shall have power to fill any vacancy that may take
place through resignation, death or refusal to act, as a commissioner
of said road. |

A Supplement to the act*, entitled, An act authorising a Lottery
to
raise a sum of money for certain purposes therein mentioned.

1. BE IT ENACTED, by the General Assembly
of Maryland, That
the lottery or lotteries authorised by the act to which this is a supplement,
shall and may be enlarged, to raise in the whole amount
a sum not exceeding one hundred thousand dollars, clear of expenses,
to be conducted under the provisions of said act, and the penalty
of the bond required thereby shall be double the amount mentioned;
and the money so raised shall be apportioned and applied,
one half to the improvement of Harford street, as directed in said
act, and the other half to the deepening and walling such parts of |
