CHAP. 188.

                                LAWS OF MARYLAND.

Second-street, and running thence west with the said street twenty-five
feet to a lot belonging to Cumberland Dugan, thence south
sixty-six feet with the last mentioned lot, to a lot now belonging to
the said company, and lately owned by the trustees of William
Belton, and others, and thence east bounding on the said last mentioned
lot, twenty-five feet to the said lot lately belonging to Justus
Hoppe, and thence north with the last mentioned lot sixty-six feet
to the place of beginning; in which said lot a certain John Mason
Forster has a leasehold interest for ninety-nine years, renewable
for ever, subject to a ground rent to the heirs of John O'Donnell,
deceased, who own the fee simple of the same, should be condemned
for a street for the use and benefit of said Exchange, and of the
said city, the said Exchange company paying the persons so interested
therein a full compensation for their respective interests, according
to a just valuation thereof to be made under the authority
of the legislature:  And whereas it also appears to this legislature,
that the said Forster is absent from this state, and resides in
a remote country, so that he cannot be applied to for the purchase
of his said interest, and that two of the heirs of the said John
O'Donnell are minors, wherefore it is reasonable to grant the
prayer of the said petition; therefore,

Lot condemned—
appraisement.




























Proviso.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
the said lot be and is hereby condemned for the purposes aforesaid,
and that Colonel John Eager Howard, Solomon Etting and
George Grundy, Esquires, be and they are hereby appointed to
appraise, as well the interest of the said John Mason Forster, as
also in the interest of the said heirs of John O'Donnel in the said
lot, the amount of which appraisements shall be paid by the said
Baltimore Exchange Company to the said John Mason Forster, or
his agent, and to the said heirs of John O'Donnell respectively;
and that the said payment shall be made or tendered in specie, or
in the notes of some incorporated bank in the city of Baltimore,
before the said Exchange Company shall take possession of the
said lot for the purpose of converting it into a street; which payments
or tender, as far as concerns the heirs of the said John
O'Donnell, may be made to his executors, or the survivor of them,
and as far as concerns the said John Mason Forster to William
Gwynn, Esquire, of the city of Baltimore, who was formerly chosen
by the said trustee as his guardian, and is hereby authorised
and empowered to receive the said payment as agent for the said
John Mason Forster; and on making the said payment or tender, as
the case may be, and not otherwise, the said Exchange Company shall
be, and is hereby authorised and empowered to take possession of
the said lot, and convert it into a public street as aforesaid, and it
shall for ever after remain a public street of the city of Baltimore;
Provided always, that if the said Exchange Company shall not on
or before the first day of May next, declare to the said commissioners
their intention to avail themselves of the benefits of this act,
and request them to the said valuation, then this act shall be
wholly void.
Trustee appointed.     2.  AND BE IT ENACTED, That the said William Gwynn shall
be and is hereby appointed agent and trustee for the said John
Mason Forster, and such other person or persons, as in case of his
